Die durch den „Spatial Turn“ entstandenen Impulse, Geschichte wieder verstärkt in räumlichen Bedingungen zu denken und Veränderungen der Raumwahrnehmung intensiver in den Blick zu nehmen, sind das Anliegen des vorliegenden Bandes. Im Fokus stehen u.a. Fragen zur kartographischen Repräsentation, zur Sozialtopographie, zu Inklusions- und Exklusionsprozessen, sowie zur unterschiedlich starken Ausprägung von Zonen städtischen Einflusses. In den Beiträgen werden ausgewählte Städte aus Mittel-, Süd- und Osteuropa beleuchtet, darunter auch Festungsstädte und die in diesem Kontext oft wenig beachteten „Kleinen Städte“. [less ▲]

À l’image de son objet, l’histoire sur le numérique est un champ de recherche jeune, issu d’une historiographie puisant à de nombreuses sources. Devenue aujourd’hui une composante de l’histoire des médias, après avoir été une composante de l’histoire des techniques et de l’innovation, elle dispose de multiples facettes : de l’histoire de l’informatique à celle des cultures numériques, elle est un champ en construction et en expansion, très ouvert à d’autres disciplines. L’évolution de l’informatique vers la micro-informatique personnelle et l’émergence du Web ont par ailleurs donné naissance à de nouvelles sources, nées numériques (aussi appelées « sources nativement numériques »), qui ouvrent de nouvelles perspectives de recherche, non sans poser des questions méthodologiques et épistémologiques également nouvelles ou renouvelées. Le numérique est aussi un outil, dont les historiens se sont emparés : l’histoire avec le numérique offre des méthodes pour analyser et lire les sources primaires nées numériques mais aussi pour écrire l’histoire. In this chapter the linear prediction (LP) and its generalisation to fractional linear prediction (FLP) is described with the possible applications to one-dimensional (1D) and two-dimensional (2D) signals. Standard test signals, such as the sine wave, the square wave, and the sawtooth wave, as well as the real-data signals, such as speech, electrocardiogram and electroencephalogram are used for the numerical experiments for the 1D case, and grayscale images for the 2D case. The 1D FLP model is proposed to have a similar construction as the LP model, i.e. it uses linear combination of fractional derivatives with different values of the fractional order. The 2D FLP model uses linear combination of the fractional derivatives in two directions, horizontal and vertical. The scheme for the computation of the optimal predictor coefficients for both 1D and 2D FLP models is also provided. The performance of the proposed FLP models is compared to the performance of the LP models, confirming that the proposed FLP can be successfully applied in processing of 1D and 2D signals, giving comparable or better performance using the same or even smaller number of parameters. Location-based gaming (LBG) apps present many challenges to the design process. They have very different requirements compared to games that are aspatial in nature. They take place in the wild and this brings unique challenges to the practicalities of their design. There is a need to balance the core game play with the spatial requirements of location-aware technologies as well as considering the overall theme and objectives of the game together with the motivations and behaviours of players. We reflect upon this balancing act and explore an approach to creative paper prototyping through the medium of board games to co-design LBG requirements. We examine two case studies of location-based games with different goals. The first case study discusses the CrossCult Pilot 4 app built to trigger reflection on historical stories through thoughtful play. Whilst the second case study uses the City Conquerer app designed and played in Suzhou, China with a view to exploring notions of territoriality. The paper considers how spatial, social and interaction metaphors are used to simulate location-based games in a board game and discusses the lessons learned when transforming the paper game into a digital prototype. It forms part of a thinking by doing approach. By comparing the board games to the technical counterparts, we consider how effective are the features and activities implemented in the technology prototypes. We propose a set of 11 design constraints that developers must be mindful of when transitioning from paper to digital prototypes. [less ▲]

This chapter draws from the experience of the collective French Web90 project to show the approaches, tools, and methodologies required to sketch a broad historical picture of the French Web during the 1990s. It also describes the limits and challenges we met during its realisation. Uncertainties about the perimeter of the French Web and its archives, data overload, progressive learning of a particular digital literacy, specific features of born-digital heritage (Newsgroups and Web archives), and using the tools for its exploration and analysis are at the heart of this study, which has progressively refined and adapted its ambitions and methodologies, notably by using methods and tools from the Digital Humanities. Um die Qualität entsprechender Lehrveranstaltungen zu sichern, führen Bildungsstätten Lehrveranstaltungsevaluationen (LVE) durch. Positive Ergebnisse bei diesen LVE stellen nicht nur ein Maß für die Qualitätssicherung der Lehre dar, sondern dienen auch als Aushängeschild für die Bildungsstätten und als Feedbackinstrument für die Lehrenden. Es stellt sich jedoch die Frage, ob Lehrende durch die Vergabe zu guter/milder Noten/Bewertungen die Evaluationsergebnisse der eigenen Lehrveranstaltung positiv beeinflussen können und es somit zu einer Verzerrung in den Evaluationsergebnissen kommt. The European Union does not have a harmonized – let alone centralized – tax system that offers specific tax incentives. It also does not explicitly regulate tax competition of its constituent parts (the EU Member States) with third countries, but only regulates “internal tax competition” among them, through the mechanism of the Code of Conduct and, even more strongly, by prohibiting State aid from being granted through tax measures. The question asked by the title of this chapter thus seems to be easily answerable in the negative: since the European Union does not make external tax policies for its Member States and does not itself provide specific tax incentives, it is not an agent of tax competition. Consequently, it would be challenging to argue that the European Union engages in harmful tax competition towards third countries. Taking a broader view, however, the notion that the European Union may engage in harmful tax competition may not be so easily dismissed, as it takes regulatory action that impacts Member States as primary agents of tax competition in a variety of ways, which can either improve or reduce the Member States’ and, by extension the European Union’s competitive position vis-à-vis third countries. Such impact takes three different routes: (i) primary EU law, affecting the design of domestic tax incentives; (ii) secondary EU law, determining certain kinds of tax incentives; and (iii) soft-law instruments, affecting domestic tax design. This contribution aims at analysing these three routes of tax competition of the European Union in order to get a deeper understanding of the ways in which the European Union may be said to engage in harmful tax competition. Before the different models can be analysed in this light, however, it is first necessary to enquire into the nature of “harmful tax competition”, a term that is all too often used without a clear definition of its content. In this chapter, we investigate the performance of a time-switching (TS) based energy harvesting model for cache-assisted simultaneous wireless transmission of information and energy (Wi-TIE). In the considered system, a relay which is equipped with both caching and energy harvesting capabilities helps a source to convey information to a destination. Based on the time-splitting mechanism, we analyze the effect of caching on the system performance in terms of stored energy at the relay and the relay-destination link throughput. In particular, two optimization problems are formulated to maximize the energy stored at the relay and the relay-destination throughput. By using KKT method, closed-form solution are obtained for both the problems. Finally, the performance of the proposed design under various operating conditions and parameter values is illustrated using numerical results. [less ▲]

Ultrascale Computing Systems (UCSs) are envisioned as large-scale complex systems joining parallel and distributed computing systems that will be two to three orders of magnitude larger than today’s systems (considering the number of Central Process Unit (CPU) cores). It is very challenging to find sustainable solutions for UCSs due to their scale and a wide range of possible applications and involved technologies. For example, we need to deal with heterogeneity and cross fertilization among HPC, large-scale distributed systems, and big data management. One of the challenges regarding sustainable UCSs is resilience. Another one, which attracted less interest in the literature but becomes more and more crucial with the expected convergence with the Cloud computing paradigm, is the notion of regulation in such system to assess the Quality of Service (QoS) and Service Level Agreement (SLA) proposed for the use of these platforms. Since its advent in the middle of the 2000’s, the Cloud Computing (CC) paradigm is increasingly advertised as a price-effective solution to many IT problems. This seems reasonable if we exclude the pure performance point of view as many studies highlight a non-negligible overhead induced by the virtualization layer at the heart of every Cloud middleware when subjected to an High Performance Computing (HPC) workload. When this is the case, traditional HPC and Ultrascale computing systems are required, and then comes the question of the real cost-effectiveness, especially when comparing to instances offered by the Cloud providers. In this section, and inspired by the work proposed in [1], we propose a Total Cost of Ownership (TCO) analysis of an in-house academic HPC facility of medium-size (in particular the one operated at the University of Luxembourg since 2007, or within the Grid’5000 project [2]), and compare it with the investment that would have been required to run the same platform (and the same workload) over a competitive Cloud IaaS offer. This chapter focuses on implicit attitudes toward smoking and provides the first systematic review of research in this domain. Implicit attitudes are suggested to guide automatic behavior, thereby playing a pivotal role for automatic processes inherent in addictive behaviors. This chapter further explores the extent to which implicit attitudes are context-sensitive. More specifically, it reviews studies that have focused on the differential effects of external cues such as warning labels and internal cues (e.g., deprivation). Results of 32 studies show that although smokers generally have more positive implicit attitudes than non-smokers, the valence of implicit attitudes varies as a result of the applied method or stimuli. Studies reveal that implicit attitudes toward smoking partly depend on external cues, especially outcome expectancies. Similarly, internal cues affect implicit attitudes whereby the level of nicotine deprivation seems vital. Implications for intervention and future research are indicated in the discussion. [less ▲]

Constitutional and economic perspectives frequently differ, including with respect to taxation. Constitutional scholars, on the one hand, typically focus on questions of justice with respect to a particular policy, together with the legal and institutional structures that aim to implement that policy, and thus look at individual rights, equity, the balance ofpowers and the proportionate consideration of diverse interests. Economists, on the other hand, are mainly interested in a particular policy's economic efficiency: they zoom in on its trade-offs, incentives, and consequences for economic welfare as a whole. It is necessary to combine both views for a holistic understanding of legal regulations. From both perspectives, it is, ultimately, a policy's practical effects that drive an assessment of its economic efficiency or its fairness. Thus, any constitutional or legal analysis ought to be imbued with a certain level of economic analysis, as justice depends on the actual outcomes of a policy, including its second-order effects. This contribution attempts to inquire the consequences of such approach in three main dimensions of timing taxation: assessment of taxes, collection of taxes, and the transition between different tax rules and systems. This chapter illustrates the process of collaborative autoethnography (co-autoethnography) we used to construct space, in order to critically explore ourselves, and the contexts we study. Through a co-autoethnographic process, we aimed to better understand our positioning in our lived experiences and to generate an understanding of how reflective critical research approaches could transform us, as well as the communities in which we were immersed. In this chapter, we share the process of our collective analysis of autoethnographic narratives (Coia L, Taylor M, Co/autoethnography: Exploring our teaching selves collaboratively. In L. Fitzgerald, M. Heston, D. Tidwell (Eds.), Research methods for the self-study of practice (pp. 3–16). Netherlands: Springer, 2009), which stemmed from our experiences living and conducting education research in multilingual and multicultural contexts. Our ethnographic method of data collection, analysis, and interpretation was generated from our journeys as researchers – moving to, living, and conducting research in culturally and linguistically diverse (CLD) environments. We share this process, and some lessons we learned, with the hope that other researchers may find co-autoethnography a cathartic methodology to explore and challenge their own perspectives relative to cultural and linguistic diversity in their lives and in their research. Teaching in inclusive settings may be considered a new, challenging task; however, successfully supporting diverse pupils in their learning process has always been at the heart of outstanding pedagogy. Vast differences both in the extent and the quality of inclusive schooling exist between and within European countries. Promoting comparison and cooperation among countries with long-institutionalized inclusive schooling and countries with less inclusive structures, cultures, and practices proves crucial in education research and reform. Building upon a multi-year collaboration, we synthesize lessons learned about inclusive education reforms and “inspiring practices“ in inclusive education in partner schools in Germany, Iceland, Lithuania, Luxembourg, Spain, and Sweden. Contemporary practices take the diversity of groups of learners into account, building upon diversity as a resource; this served as the framework for our collaboration. The TdiverS consortium—as an EU-funded Comenius Network Project “Teaching Diverse Learners in (School-)Subjects“ (TdiverS)—was built on the following principles and goals: (1) diversity in theory and practice, resulting from collaborations of practitioners and scientists exchanging knowledge about teaching in inclusive settings; (2) strengthening awareness of the diversity of frameworks, conditions, and determining factors of teaching inclusively in varying cultural contexts; and (3) inclusive education research uniting multilevel, multicultural, and multidisciplinary perspectives. We highlight the values of inclusive education, map its contemporary European geography, summarize contemporary country-level education reforms and the local development of inclusive practices in six countries, and discuss lessons learned across Northern, Eastern, Southern, and Western Europe. In line with our earlier work, we will take the material object – the technological device – and, more specifically, the sensorial and experiential dimensions expressed in media use as a point of departure for our reflections. Why would the sensorial and experiential dimensions of media use be a relevant point of departure for such reflections? And, by extension: why would such reflections help to theoretically frame media newness? The answer, as we will argue, is that the (media) technologies used for communication and information purposes work quite differently on users than, for instance, technologies of transportation. Media technologies stand out amongst the broad range of technologies used by humans, such as trains, aeroplanes and elevators in as far as media technologies typically use representation as a means. As such, they affect users in a very specific way, quite different from trains and aeroplanes. Moreover, media technologies stand out among the media such as language because of their technical make-up, as Kittler has convingingly argued; for this reason, he labeled media technologies, somewhat tautologically as he would admit, “technical media”. In Part 3, we will first discuss the concept of “technical media” to address the question of why and how media technologies require special treatment in both media and technology research in terms of the traces they leave in representation – with considerable implications for the user experience. Next, in Part 4, we will address the question as to why the sensorial effects created by technical media would typically be accompanied by a distinct experiential dimension and why this would help create the famous cyclical effects in the history of media use. In Parts 5 and 6, then, we will discuss the implications for media historiographical research. [less ▲]

Physical activity plays an important role in children’s growth and development. Understanding why a child is active or inactive is, therefore, essential for prevention of and intervention in childhood obesity. This narrative review provides an up-to-date summary of the literature pertaining to biological, psychosocial and environmental factors affecting young children’s acquisition of physical activity behaviour. Physical activity-related traits are characterized by familial aggregation and influenced by genetic factors. Nevertheless, the genetic contribution to physical activity shows increasing expression with age, supporting the need for interventions in early childhood. In addition to genetic factors, a range of psychosocial and environmental factors that are associated with physical activity in children have been identified: boys are more active than girls, and children with active parents tend to be more active. Overall physical activity support provided by parents predicts children’s organized physical activity. Perceived road safety and threat posed by strangers are major causes of parental anxiety in relation to their children’s safety in the neighbourhood. Programmes designed to increase physical activity should promote the importance of physical activity to parents. In addition, improving perceived safety may help to ease parental restriction of their children's active transport and physical activity. [less ▲]

States from the Asian region have not been the loudest participants in the backlash against investment treaty arbitration. That does not mean that they have not reacted to an evolving arbitral practice allowing easy access of foreign investors to international arbitration. This chapter examines the action taken by several Asian states, particularly in the form of detailed treaty provisions, aimed to reassert the gateway to investment dispute settlement at the international level. It is argued that although state reaction in Asia has not been systemic and radical, but rather occasional and modest, it is based on the same sovereignist rationale, which assumes that harder conditions of access to international arbitration protect better state sovereignty. That reaction, however, will probably not produce the desired effects, because it does not follow the emergence of arbitral jurisdictional regulation, which has developed jurisdictional rules capable of tackling harder conditions of access, in light of the internationalised and depoliticised nature of investment disputes. Fragen der Steuerung, der Governance, hingegen, sind bisher im deutschsprachigen Raum nur wenig systematisch oder umfassend analysiert worden, obwohl mehrere Wissenschaftsdisziplinen sich zunehmend mit diesen Fragen auseinandersetzen. Die Erziehungswissenschaft, nicht nur in der deutsch-sprachigen Welt, hat sich lange Zeit schwer getan, sich eindeutig zu den brisanten bildungs- als auch sozialpolitischen Fragen der inklusiven Bildung – auch die zentrale Frage der Governance – zu positionieren, weil es das fundamentale Verhältnis von Allgemeiner und Sonderpädagogik hinterfragt sowie in letzter Konsequenz die Transformation des gegliederten und hochgradig selektiven Bildungswesen verlangt. Dieser Band beleuchtet eben dieses Spannungsverhältnis aus verschiedenen Perspektiven; in diesem Beitrag wird deshalb versucht, verschiedene Dimensionen der Governance auf der Forschungsagenda zu platzieren, wie auch in zwei konkreten Fällen – Deutschland und Luxemburg – zu vertiefen. Largement connue et en partie justifiée, la critique à l'égard des principes des CIAM, des projets et des résultats concrets en découlant n'a jamais suffisamment tenu compte de leur décalage avec les défis environnementaux et sociaux de la ville contemporaine. Conçu pour atteindre des objectifs d'émancipation sociale, le cadre urbain des derniers cent ans se doit d'être évalué quant à sa résilience face aux crises écologiques qui s'annoncent. En somme, quid de la ville moderne en tant que relais entre la première modernité et le projet de transition écologique? Cet ouvrage aborde cette problématique aussi bien sous un angle théorique et critique, qu'à travers l'étude de l'évolution de la ville moderne dans son épicentre géographique européen et en dehors de celui-ci. Des thèmes de recherche originaux sont ainsi esquissés entre visions globales et cas d'étude, diagnostics et prospectives, en reconstituant les trajectoires d'éminentes personnalités et de collectifs dynamiques. Il s'en dégage une aporie disciplinaire saisissante, celle de la trajectoire prise par la ville du 20e siècle, sans doute prometteuse pour les individus, mais fort ambiguë pour les communautés et certainement trop exigeante pour la biosphère. Screening powers of arbitral institutions over requests initiating investment arbitrations are often justified by the need to prevent embarrassment of states and to avoid unnecessary costs. This Chapter examines possible effects of such powers, particularly on the arbitral development of the jurisdictional standards governing investment arbitration. Can administrative organs filter the demands for legal change that will be heard before tribunals, and if so, does this diminish the legitimacy of their screening powers? It is argued that screening powers offer possibilities of setting arbitrators’ agenda in terms of which demands for legal change will be considered. This could affect their legitimacy, but it does not mean that screening powers have completely lost their justification. It is suggested that such powers must be exercised with an extreme level of diligence, requiring an almost complete elimination of legal considerations, in order to safeguard their legitimacy. Räumliche Mobilität ist ein konstitutives Merkmal ökonomisch hochentwickelter Gesellschaften. Hierzu zählen traditionell mobile Lebensformen innerhalb eines Nationalstaates, mit zunehmender Wichtigkeit aber auch grenzüberschreitende Mobilität (Schneider, Meil 2010; Viry, Kaufmann 2015). Während man im 20. Jahrhundert unter internationaler Migration fast ausschließlich die Zuwanderung in westliche Industriestaaten verstand, rückt zunehmend die Rolle dieser Staaten als Herkunftsländer in den Fokus (van Dalen, Henkens 2013). Die Migration zwischen den OECD-Staaten stellt heute einen zentralen Bestandteil des globalen Wanderungsgeschehens dar (OECD 2015). Auch wird internationale Mobilität und damit zusammenhängend der Aufbau von „transnationalem Humankapital“ (Gerhards, Hans 2013) bzw. „interkulturellem Kapital“ (Pöllmann 2013) oder „Mobilitätskapital“ (Kaufmann et al. 2004) als eine wichtige Ressource für eine erfolgreiche Partizipation in einer zusammenwachsenden Welt und ihren Systemen und Institutionen gesehen. Aus dieser Perspektive hat der „mobility turn“ (Grieco, Urry 2016) weitreichende Auswirkungen für die Verteilung gesellschaftlicher Ungleichheiten. Über grenzüberschreitende Kontakte und Beziehungen zu verfügen, gilt mittlerweile als ein wesentlicher Faktor zur Bestimmung sozialer Positionen (Beck 2008; Weiß 2005). Im europäischen Kontext bestehen bereits erste Hinweise, dass Mobilität einen Einfluss auf die ökonomischen und gesellschaftlichen Teilhabechancen hat (Cresswell 2006; Ohnmacht et al. 2009), ohne dass dies jedoch bislang systematisch untersucht worden ist. Während Migrationsprozesse aus ärmeren Weltregionen in ökonomisch hochentwickelte Gesellschaften und politisch gefestigte, demokratische Wohlfahrtsstaaten theoretisch und empirisch intensiv erforscht worden sind (Castles et al. 2014; Massey et al. 1999), wissen wir bislang vergleichsweise wenig über die internationale Mobilität von Bürger*innen eben jener Wohlstandsgesellschaften selbst (Favell et al. 2007). Darüber hinaus zielen die meisten der vorliegenden Studien zur Auswanderung aus ökonomisch hochentwickelten Gesellschaften auf die Rückwanderung von Migrant*innen in ihre ehemaligen Heimatländer (Constant, Massey 2003; Ghosh 2000). Im Vergleich zu anderen Bereichen in der Migrationsforschung ist die internationale Migration aus hochentwickelten Staaten vergleichsweise wenig erforscht. Vereinzelte Studien, wie zum Beispiel EU-CROSS (Recchi et al. 2019; Recchi 2014) oder PIONEUR (Recchi, Favell 2009) sind vom Design nicht darauf ausgelegt und deswegen auch nicht in der Lage, theoretisch weiterführende Fragen zu den individuellen Konsequenzen internationaler Migration für den weiteren Lebensverlauf zu beantworten. Diese befassen sich vielmehr mit spezifischen Phänomenen, wie transnationalen Lebensformen sowie ihren Konsequenzen für Identität, politische Einstellungen und Integration (Rother, Nebe 2009). Ein Grund für diesen unbefriedigenden Forschungsstand ist sicherlich der eher spärliche Datenbestand – ein Umstand, der eng damit zusammenhängt, dass die Erfassung international mobiler Bevölkerungsgruppen vor einigen methodischen Herausforderungen steht (Ette, Sauer 2010: 34–45). Mobile und insbesondere international Mobile sind ein Paradebeispiel für eine „hard to study population“ (Lynn et al. 2018). Bisherige Versuche, diese Migrantengruppe im Rahmen bestehender harmonisierter internationaler Surveys (zum Beispiel European Social Survey oder European Union Labour Force Survey) zu untersuchen, werden durch unzureichend erfasste Informationen über den Migrationsprozess erschwert (Erlinghagen 2011; Ette, Sauer 2010). Auch bestehende sozialwissenschaftliche Panelstudien stoßen bei solchen Fragestellungen räumlich an ihre Grenzen. Diese orientieren sich nämlich in der Regel an den Grenzen der Nationalstaaten. Für Zuwander*innen und Rückwander*innen resultiert daraus, dass sie erst ab dem Grenzübertritt in ihrem Zielland untersucht werden können und somit meist als „Personen ohne Vorgeschichte“ (Vermeulen 2010, S.1224) in diesen Datensätzen erscheinen. Umgekehrt können Auswander*innen in Panelstudien ihres Herkunftslandes nur bis zum Auswanderungsereignis ‚verfolgt‘ werden, da sie anschließend den nationalstaatlichen Beobachtungsraum verlassen und dieses Ereignis mit einem Ausscheiden und somit faktischer Panelmortalität verbunden ist. Auch die Erweiterung bestehender Panelstudien um diese international mobile Bevölkerungsgruppe scheitert bisher aufgrund geringer Fallzahlen (Schupp et al. 2008). In der Konsequenz fehlen in Deutschland, aber auch den anderen OECD-Staaten, adäquate Datengrundlagen zur Untersuchung der Dynamik von Wanderungsprozessen und ihren individuellen Konsequenzen. Hier setzt die „German Emigration and Remigration Panel Study“ (GERPS) an und untersucht die Prozesse internationaler Migration anhand eines völlig neuen theoretisch konzeptionellen Ansatzes, dem „Destination-Origin-Migration-Ansatzes“ (DOM-Ansatz; vgl. Erlinghagen, Ette 2019 sowie den folgenden Abschnitt). Im nächsten Abschnitt werden zunächst die Grundüberlegungen dieses DOM-Ansatzes skizziert. Anschließend wird die neu zu konzipierende Längsschnittstudie GERPS näher vorgestellt. Der Beitrag endet mit einer zusammenfassenden Schlussbetrachtung. [less ▲]

The study of the upper tail of the income and wealth distributions is important to the understanding of economic inequality. By means of the ‘isograph’, a new tool to describe income or wealth distributions, the authors compare wealth and income and wealth-to-income ratios in 16 European countries and the United States using data for years 2013/2014 from the Eurozone Household Finance and Consumption Survey and the US Survey on Consumer Finance. Focussing on the top half of the distribution, the authors find that for households in the top income quintile, wealth-to-income ratios generally increase rapidly with income; the association between high wealth and high incomes is highest among the highest percentiles. There is generally a positive relationship between median wealth in the country and the wealth of the top 1%. However, the United States is an outlier where the median wealth is relatively low but the wealth of the top 1% is extremely high. [less ▲]

The present article retraces the history of the “Taricco saga” before the Court of Justice of the European Union (CJEU), which put in the spotlight the clashes between the primacy and effectiveness of EU law in the field of the protection of the financial interests of the EU, and the constitutional identities of the Member States with regard to fundamental rights in criminal law. Starting from the analysis of the first firm stance of the CJEU in the Taricco I judgment, to the Italian Constitutional Court’s reaction in defence of its own interpretation of the principle of legality in criminal law, the article then focuses on the final revirement of the CJEU towards a more tolerant position in M.A.S. and M.B.. The author, building upon the notion of constitutional pluralism and tolerance, does not consider such outcome as a defeat for the primacy of EU but rather welcomes it as a first step towards a more inclusive approach to the principle of primacy of EU law that necessarily encompasses fundamental rights and constitutional traditions, and that takes into due consideration the specificities of criminal law.
