It stresses the interplay of courts and scholars in imbuing EU administrative law with state-based traits of EU law, the role of this development in upholding the legitimacy of EU law, the tensions it introduced and the limits of the integration function of comparative administrative law. It concludes that legal scholars should take a critical distance to the role that comparison has had in shaping our conceptions of EU administrative law, and in fashioning it a state-like manner, and query the extent to which they remain actual in the current legal context. This chapter characterizes transparency as an ambivalent principle of EU law and governance, serving both a functional and a democratic rationale. The analysis focuses on the right of access to documents, a right whose scope and democratic function very much depend on who requests and on the interpretation of the exceptions to access. While the former is a matter of practice, the latter is essentially the result of the main approaches that the Court of Justice of the European Union (CJEU) has followed hitherto: strict interpretation and application of the exceptions, on the one hand, and general presumptions of non-disclosure, on the other. The paper presents both. It argues that, while much criticized in the literature as contrary to the democratic function of the regulation on access to documents, general presumptions of non-disclosure merit a more nuanced analysis. They can be, under restricted circumstances, a way to protect the democratic function of the citizen’s right to access. Yet, the uncertain and evolving criteria for the establishment of a general presumption of non-disclosure have effectively carved out whole categories of documents from the possibility of access, insulating significant sections of EU public action from the pressure of democratic claims. Die Energiesynchronisationsplattform adressiert den gesamten Prozess des automatisierten Energieflexibilitätshandels von der Maschine bis zu den Vermarktungsservices. Sie stellt somit das übergeordnete Gesamtkonzept eines digitalen Ökosystems dar, welches industrielle Nachfrageflexibilität ermöglicht. Die Energiesynchronisationsplattform besteht dabei aus unternehmensindividuellen Unternehmensplattformen und einer zentralen Marktplattform. Der Marktplattform kommt die Rolle der Servicevermittlung zu. Dies ermöglicht es, auf Veränderungen innerhalb der Services bzw. der Marktplattform schnell reagieren zu können. Im vorliegenden Kapitel werden beispielhafte Services der Unternehmens- und Marktplattformen beschrieben. Zudem wird ein Überblick über die Referenzabläufe für den Betrieb und die Vermarktung von Energieflexibilität gegeben. Die Prozesse werden anhand eines möglichen Anwendungsfalls dargestellt. Außerdem wird das weiterentwickelte Energieflexibilitätsdatenmodell vorgestellt und anhand von vier Klassen beschrieben. Zur Bedrohungsanalyse im Kontext der IT-Sicherheit werden Threat Models (Bedrohungsmodelle) angewandt und auf Basis verschiedener Sicherheitslevels vorgestellt. Formal education is a very important, time-intensive, and highly consequential aspect of adolescents’ everyday life. School as well as education can influence adolescents’ well-being in both the short- and long-term. In return, adolescents’ well-being in- and outside school may affect their educational achievement. The objective of the present study is to investigate how self-reported dimensions of adolescents’ subjective well-being (SWB) in an educational context (i.e., academic self-concept, school anxiety, social and emotional inclusion) relate to educational pathways (regular vs. irregular school transitions; attendance of more vs. less prestigious secondary school tracks) and standardized assessment scores in key academic areas (i.e., mathematics and languages). Drawing on representative data emerging from the Luxembourg School Monitoring Programme “Épreuves Standardisées” (academic year 2018/2019), the relationship between academic achievement and students’ self-reported well-being was analysed cross-sectionally for the entire student cohorts of 5th and 9th graders. Result indicated that grades and educational pathways affect SWB, whereby in general lower ratings of SWB were observed in older students, students that experienced grade retention and students in lower secondary school tracks. Furthermore, ratings of SWB explained a significant proportion of variance in academic achievement in bot Grade 5 and Grade 9. These findings highlight the importance of student´ SWB in education. SWB may not only affect academic achievement, but also impact motivation and engagement and hence long-term educational success. Implications of the findings for research and educational debate are discussed. [less ▲]

Linguistische Studien zum Thema Fake News nähern sich diesem Phänomen hauptsächlich aus zwei verschiedenen Richtungen. Mit Methoden der kritischen Diskursanalyse wird untersucht wie der Begriff Fake News im öffentlichen Diskurs verwendet wird, welche Vorstellungen geschaffen, welche Identitäten konstruiert werden und welche Machtverhältnisse erzeugt, verteidigt oder herausgefordert werden. Computerlinguistische Ansätze beschäftigen sich mit der Charakterisierung und automatisierten Erkennung von Fake News, um diese von sogenanntem „rechtmäßigen“ Nachrichten (legitimate news ) zu unterscheiden. Textlinguistische Untersuchungen zum Thema Fake News gibt es bisher kaum. In diesem Beitrag wird zuerst den wenig vorhandenen linguistischen Definitionsansätzen von Fake News auf den Grund gegangen, mit dem Ziel diese durch die textlinguistische Analyse zu ergänzen. Danach werden die beiden sprachwissenschaftlichen Zugänge zum Phänomen Fake News vorgestellt und einige Untersuchungen zum Corona-Diskurs skizziert, die für die Beispielanalyse relevant sind. Exemplarisch werden in der vorliegenden Untersuchung redaktionelle Beiträge und Fake News zum Corona-Diskurs qualitative analysiert und miteinander verglichen. Damit wird der Versuch unternommen Fake News als Textsorte einzuordnen und die sprachlichen Strategien herauszuarbeiten, die für dieses Phänomen typisch sind. Die zuvor erwähnten linguistischen Zugänge liefern dabei wertvolle Ergebnisse, die als Ausgangsbasis für diese Untersuchung dienen. Die Analyse zeigt, dass sich Fake News zwar an journalistischen Nachrichtenformaten orientieren, jedoch sprachliche Muster aufweisen, die sie von diesen unterscheiden. Unter anderem benutzen sie sprachliche Strategien wie Polarisierung, starke Wertungen und direkte Leseradressierung, die für redaktionelle Berichterstattung unüblich ist. Diese Strategien sind nicht nur für Fake News typisch, sondern weisen eine gewisse Parallele zu sprachlichen Mustern in Verschwörungstheorien und Propaganda auf. [less ▲]

The COVID-19 pandemic has not only sparked a renewed interest in history; it has also focused our attention on how the present can be historically preserved. Therefore, it is safe to predict that the COVID-19 crisis and its documentation will be analyzed by future historians, and it will bring about methodological and technological changes that affect our ways of working as historians of education. This chapter will examine the following: First, it looks at some basic characteristics of web archives and how they challenge our work as historians. Second, it offers reflections on different modes of archival access and on how this may affect current concepts of the past. Third, the chapter discusses how web archives relate to public history and, next, introduces the Education & Pandemics Archive launched by the International Standing Conference for the History of Education (ISCHE). The chapter will also provide preliminary insights into how web archives may affect our work as historians of education. Web archives offer different structures, opportunities for different interactions and technological environments. They can be characterized by collaborative processes by networked data within a flattened structure, and by interconnected hardware and software environments. Web archives are user-friendly, flexible and invite us to get involved and to develop new historical dimensions. [less ▲]

Vaccination is considered as the most effective solution to fight against the COVID-19 epidemic as well as other contagious and infectious diseases to bring the world to a "new normal" lifestyle. This lifestyle is defined as a new way of living our work, routines, and interactions with other people to adapt with COVID-19. With the ambition to open up the economy, many countries such as United Arab Emirates, Portugal, and Singapore have achieved the coverage rate of COVID-19 vaccines for the 2nd dose above 80%. However, when the vaccine has not been evenly distributed to all countries worldwide, it means that COVID-19 cannot be ended. This is because fully vaccinated people can still be positive with COVID-19, and the effectiveness of the vaccine also decreases significantly after 6 months. Therefore, protective measures like social distancing, wearing mask, and frequent handwashing must also be practiced simultaneously to enable the "new normal" lifestyle. In this chapter, we discuss the open issues of social distancing implementation such as pandemic mode, hybrid technology solutions, security and privacy concerns, social distancing encouragement, real-time scheduling, and negative effects. Furthermore, potential solutions to these issues are also discussed. [less ▲]

Cela lui vaut, en 1803, un exil à quarante lieues de Paris – au grand dam de l’écrivaine, confondue face à « cette inconcevable rigueur contre une femme qui a peut-être quelque force dans l’esprit, mais beaucoup de faiblesse dans le caractère ». Cette formule montre bien, dans l’espace intime par essence qu’est la correspondance, la tension à l’œuvre chez Staël entre la force et la faiblesse assignées au féminin selon les circonstances. À la force de l’esprit s’oppose en effet la force de Napoléon, « puissant des puissants » dont le pouvoir « dissipe, non le sentiment, mais la résistance. » Or Staël peut opposer à cette force capable de « l’anéantir » un pouvoir inaliénable, jusque dans l’exil : celui de la « vraie pensée », qui « est de l’âme et de la force ». C’est qu’il y a « une force dans le vrai qui est tout à fait indestructible », lorsque Napoléon « n’[a] que la toute-puissance pour asile ». The taxation of interest in cross-border situations can often give rise to instances of discrimination, many of which can be remedied through a careful consideration of the non-discrimination rules contained in Article 24 OECD MC. This provision operates in tandem with the distributive rules of the tax treaty, but is not, in general, limited by them. A core difficulty of the application of the non-discrimination provision lies in establishing comparability of situations necessary to identify acceptable distinctions drawn in national law from those that are prohibited. This is especially challenging in the context of interest deduction limitation rules, which often do not simply attached consequences to the recipient's residence but to other criteria, which are however closely linked. This chapter proposes a test that builds on the traditional idea of simply adding the protected condition to characteristics of the disadvantaged taxpayer but refining this approach by searching for scenarios in which the "closely linked" criteria can the detached from each other to single out the basis of the discrimination. This test aims to improve on the rather rough traditional approach without the need for reference to a state's alleged discrimination aims and their "legitimacy" within the international tax system. The contribution goes on to show that both Article 24(4) and Article 24(3) OECD MC have an important role to play for cross-border interest payments to ensure equal treatment with respect to deductibility, the level of taxation and the granting of withholding tax credits. A major body of evidence points to the significant associations between views on aging (VoA) and key developmental outcomes, such as health and well-being. While much of this evidence comes from longitudinal studies, research on VoA has also been strongly experimental since its inception. Our chapter aims to provide an overview about the major lines of prior experimental research on VoA and by this means derive its role for present and future VoA research overall. We first offer an organizing scheme for the existing body of experimental work on VoA. We arrive at the conclusion that previous experimental research on VoA with older adults has been conducted in a broad range of studies with different dependent variables and experimental manipulations, showing the importance of VoA and their impact on a wide range on phenomena. We then go into more detail of VoA research that has been done in the past decade. Here, our conclusion is that recent experimental research on VoA is taking up societal challenges, such as the aging workforce, older people in the health care system, and stereotype threat elicited by digital technologies. At the same time, current VoA research is adding to the differentiation of established effects in the prior literature as well as helped to identify moderating and contextual conditions not considered previously. We end with a set of recommendations for future experimental VoA research including strengthening the needed liaison with other research formats. [less ▲]

Leprosy is a disease that has accompanied mankind since the times of the Old Testament and is still widespread in parts of the world today. Its history is marked by contrasts: on the one hand, misery, infirmity and exclusion that could even lead to pogroms, on the other hand, religious exaltation, privilege and exceptional care. This ambivalence is typical for the treatment of lepers in the Middle Ages and in the early modern period. And it is also reflected in the prejudices and stereotypes with which those suffering from leprosy were confronted. The study examines the attributions and prejudices, both positive and negative, with which leprosy patients were confronted. and prejudices, both positive and negative, with which the group of leprosy patients was confronted and what effects these had on their living conditions. The analysis of selected written and pictorial sources from the Middle Ages and the early modern period shows that prejudices and attributions, both positive and negative, were of decisive importance for the lives of medieval and early modern lepers. This applies both to the definition of the social group from the outside and to the self-descriptions of the lepers, which referred to positively connoted religious ideas. Above all, the ambivalence of attributions and prejudices is characteristic. Prejudices against the lepers remained strikingly changeable depending on the context in the longue durée from the Middle Ages to the early modern period. This became most clearly visible in the crisis period of the 1320s, when even the positive attributions of salvation could not protect lepers from pogroms. [less ▲]
