This book is the result of a conference held at the University of Luxembourg on 23 January 2014, which aimed to analyse the Court of Justice’s most important decisions on direct taxation and their transformative impact on direct taxation in the EU over the last three decades. Each chapter in this book is based on the authors’ presentations at the conference, in which they focused on a particular landmark decision of the Court of Justice as a starting point for the development of a specific doctrine and followed its development through decisions in later years, critically assessing the strengths and weaknesses of the Luxembourg Court’s reasoning and its path through the complex field of cross-border income taxation. Due to the nature of this project, the individual chapters’ topics, such as the Schumacker doctrine, the Marks & Spencer exception, or the impact of Cadbury Schweppes, will seem familiar to readers who are well versed in EU tax law. Yet, the depth of the analysis of each landmark case, which is explored from its historic roots and original reasoning, allows the reader to gain an unparalleled understanding of the development and minute changes in the relevant subsequent jurisprudence as the authors chart a way through the nuances of the Court’s arguments. The essays in this book respond in different ways to questions regarding sovereignty, constitutionality and social solidarity in the European Union. Some of the essays perceive a threefold deficit in this regard – a constitutionality, sovereignty and solidarity deficit. The common view that can be distilled from them relates to a perception that the people and peoples of the European Union have drifted into a quagmire of political paralysis within which essential features of the paralysis – lack of constitutionality, lack of sovereignty and lack of social solidarity – feed off one another. Lack of solidarity, not only between European citizens, but also between Member States of the European Union, derails all possibilities of common political initiative, fervour and purpose. And absence of such common initiative, fervour and purpose quite evidently explains the faltering of Europe’s constitutional project and the reduction of this project to that which Jürgen Habermas has come to call Europe’s “mindless incrementalism.” Unable to arrive at the constitutionality that would allow for the emergence of European sovereignty, the faltering constitutional process has only managed to dismantle essential elements of sovereignty and social solidarity within the Member States of the European Union. This has led to the double edged lack of sovereignty (lack of sovereignty at EU level and lack of sovereignty in the Member States) that has lead Dieter Grimm to observe (also in his contribution to this book) that there may well be no true sovereign left in Europe today. Against this background, it is perhaps no surprise that a non-sovereign body would step in to take over the responsibilities of sovereign government, and do so on the basis of the only principle that appears prima facie legitimate under circumstances of political paralysis, namely, the ordo-liberal principle of reducing politics to guardianship of free competition between individuals that replaces constitutional law with competition law; hence the crucial role that the market-liberalisation jurisprudence of the European Court of Justice have come to play in the non-sovereign or surreptiously-sovereign way Europe is governed today. To be sure, not all the essays in this book share this grim view. A number of them discern an emergence of new forms of democracy or even new forms of political legitimacy in the complex structures of multi-level governance in the European Union. Between them, however, the spectrum of essays that make up this book undoubtedly provides the reader with a comprehensive study of the key issues of European politics and law today. [less ▲]

It provides an understanding of the key challenges and opportunities for rural regions arising from the major economic, social, political and cultural changes associated with globalization, including trade liberalization and economic deregulation, increased international migration, and the rise of global consciousness about environmental issues. Drawing on examples and findings from a major European research project, DERREG, the book presents detailed case studies of ten regions in different parts of Europe, exploring the factors that lead to different experiences of globalization in each of the regions, and highlighting examples of good practice in regional development responses. The book concludes by proposing a typology of regional responses to globalization and considering the policy implications of the research findings. The current retrenchment of the welfare states is buffering the growing demographic and economic pressures in European countries at the expense of the young and the elderly. However, both investment in the young, which determines a society’s future, and providing public support for the elderly, the most deserving needy group, are seen as musts. This book encompasses a selection of empirical studies reflecting on when and why the young and the elderly are at risk in several (mostly Western) European countries. Contributions in the book examine the educational achievement and the labor market entry of youths, particularly those who have a migration background, the poverty risk experienced by the elderly, especially if they are also immigrants and/or women, the pension outcomes of former cross-border workers, the simulated consequeces of a recent pension benefit reform as well as those of a potential reform including financial assets and housing wealth in old-age income protection, and finally the extent, and possible erosion, of the support for government providing child-care and protecting the elderly. Tel est l’objet de ce livre collectif et interdisciplinaire, où alternent études de cas et réflexions transversales. En observant la participation des chercheurs et experts à Wikipédia, l’ouvrage cherche notamment à identifier des enjeux en termes d’intermédiation des savoirs, de structuration et de reconnaissance d’un champ ou de diffusion de la culture scientifique. Il a aussi pour ambition de présenter les problématiques soulevées par les chercheurs qui se sont saisis de Wikipédia en tant qu’objet de recherche, pour étudier la transformation des formes de savoir, les processus d’élaboration des articles et la gouvernance de l’encyclopédie. Moving beyond this essentialising representation, this volume explores African literacies within their complex and diverse multilingual and multiscriptal histories and contexts of use. The chapters choose contexts from the Maghreb to Mozambique and from Senegambia to the Horn of Africa, and critically analyse multiple literacy genres and practices - from ancient manuscripts to instant messaging - in relation to questions of language-in-education and policy, livelihoods, Islamic scholarship, colonialism, translocal migration and writing systems. A key theme of the Conference and Summer School was the interplay between theory, algorithms and experiment. The 14 papers offer readers both, instructional courses on the latest algorithms for computing modular and automorphic forms, as well as original research articles reporting on the latest developments in the field. The three Summer School lectures provide an introduction to modern algorithms together with some theoretical background for computations of and with modular forms, including computing cohomology of arithmetic groups, algebraic automorphic forms, and overconvergent modular symbols. The 11 Conference papers cover a wide range of themes related to computations with modular forms, including lattice methods for algebraic modular forms on classical groups, a generalization of the Maeda conjecture, an efficient algorithm for special values of p-adic Rankin triple product L-functions, arithmetic aspects and experimental data of Bianchi groups, a theoretical study of the real Jacobian of modular curves, results on computing weight one modular forms, and more.
