La conférence intergouvernementale sur la révision du traité sur l'Union européenne qui s'est terminée les 16 et 17 juin 1997 avec le Conseil européen d'Amsterdam a ranimé un vaste débat doctrinal sur la question de savoir s'il convient de doter l'Union européenne d'une constitution. Le présent ouvrage se propose d'apporter une contribution à cette réflexion par l'étude du droit des Communautés et de l'Union européenne selon une approche "constitutionnaliste", qui fait apparaïtre le caractère constitutionnel du droit communautaire originaire à travers l'étude de ses sources formelles et matérielles. Ce droit s'insère néanmoins dans une évolution plus vaste caractérisée par l'émergence d'un "droit constitutionnel européen" qui implique aussi les constitutions des Etats européens et la Convention européenne des droits de l'homme. L'existence, la formation et le contenu du droit constitutionnel européen sont successivement traités dans la sphère de l'Union européenne. La première partie du livre concerne la notion mème de "constitution européenne". Peut-on légitimement parler d'une constitution là où il n'y a pas d'Etat ? Après avoir cerné la notion de constitution dans une perspective historique et dans son contexte actuel, l'ouvrage examine la pertinence d'une transposition de la notion de constitution hors du cadre étatique et présente les principales composantes du droit constitutionnel européen en émergence ainsi que leurs interrelations. La seconde partie est consacrée à l'analyse des sources formelles du droit constitutionnel des Communautés et de l'Union européenne. Elle a pour premier but de faire comprendre comment la charte constitutionnelle actuelle de la Communauté a pu s'élever sur la base des traités fondateurs qui forment son fondement conventionnel tout en s'enrichissant dans un processus de développement constitutionnel alimenté par la jurisprudence et la pratique institutionnelle. Cette partie aborde ensuite les problèmes juridiques soulevés par l'élaboration d'une nouvelle constitution de l'Union européenne par la voie d'un acte constituant. Le troisième thème est celui des sources matérielles du droit constitutionnel des Communautés et de l'Union européenne. Sont mises en évidence les sources d'inspiration de ce droit à l'aide d'une présentation des principes constitutionnels les plus significatifs. A cet effet, l'ouvrage dresse un inventaire du corpus constitutionnel de l'Union européenne et discute la nature économico-politique de la constitution communautaire. L'examen des valeurs fondamentales et des principes structurels qui caractérisent l'Union européenne tels que les principes démocratiques, de la prééminence du droit, de la subsidiarité, de la loyauté communautaire et de l'équilibre institutionnel parachève la démonstration. The island of Rügen has a rich potential for tourism. Apart from the famous chalk cliffs and 50 miles of beaches the island has a remarkable variety of scenery and a great number of historico-cultural attractions. Tourism at Rügen dates back to the end of the 18th century. It reached its first peak around 1900. After the 2nd World War state/union-run recreational organisation replaced the in-dividual tourism of the more prosperous people. This socialistic form of tourism was not based on economical principles but was part of the social welfare. 97% of the people of the GDR went on do-mestic holidays, one ninth of them to the island of Rügen. The German unification and the following process of restructuring had their effects on the tou-rism at Rügen as well. The chances and the risks of the restructuring have been examined in this thesis. The socialist period had a lot of positive effects on the development of tourism at Rügen prior to the actual restructuring process. This was partly due to the economical weakness of the GDR, and partly to the missing of typical capitalist structures. The lack of land speculation for example explains the 95% of unspoiled coastal areas. Some classical Baltic seaside resorts are still well preserved. Negative consequences of the socialist period are for instance ecological damages, poor con-ditions of scenic buildings at the resorts and the very low level of various kinds of infrastructure. The actual reshaping of tourism offers the chance to correct the negative consequences of the socialist period and to use its positive consequences for an adequate tourism development. The fact, that this develop¬ment starts 20 years later than in West Germany, offers the chance to learn from the mistakes made not only on the West German coasts. The sudden reorientation towards the market economy following the slow but continuous socia-list development also contains some considerable risks. Above all there is the deterioration of the landscape and the dying of the small-scale private accommodations caused by newly-built modern holiday-centers. There are also risks that municipalities will be subject to dishonest speculation, or that adjoining municipalities may suffer through exaggerated economic rivalry. While the negative consequences of the socialist past are mostly reversible, today's West German investment can cause irreversible changes to the landscape. In '90/'91 there was an increasing number of West German short-term visitors. They outweighted by far the long-term visitors. A solid base for the development of tourism is provided by the main pool of potential visitors reaching to Nordrhein-Westfalen, Sachsen and Sachsen-Anhalt. Due to the German unification, Rügen became over night a major attraction in the frame of tourism-projects in Germany. The latter fact causes some new problems for the island. The district government of Rügen has set ambitious goals for the development of an ecologically and socially tolerated tourism, but the realization will not be easy. However, a cautious optimistic prognosis seems reasonable. [less ▲]

Luxemburg ist heute verfassungsgemäß dreisprachig: Im Sprachgesetz von 1984 wurde Luxemburgisch als Nationalsprache und Französisch als Sprache der Gesetzgebung festgelegt. Beide fungieren – neben dem Deutschen – als Verwaltungs- und Gerichtssprache. Im Folgenden steht die Entwicklung des Deutschen im "langen 19. Jahrhundert" im Mittelpunkt. Während für die Standardisierung des Deutschen im 19. Jh. für Deutschland, Österreich und die Schweiz ausführlich erforscht ist, steht eine Einordnung und systematische Untersuchung Luxemburgs noch aus. Dies erscheint umso erforderlicher als sich in dieser Zeit die Emanzipation des Luxemburgischen aus dem Varietätengefüge des Deutschen vollzieht (Gilles 2000). Der Diskurs zur Standardisierung des Deutschen ist thematisch verwoben mit dem einsetzenden Diskurs zur Standardisierung des Luxemburgischen (Newton 2002, Gilles/Moulin 2003). Anders als die Diskurse zum Moselfränkischen/Luxemburgischen, in deren Mittelpunkt die Abgrenzungen von 'Dialekt/Mundart' und 'Hochsprache/Standardsprache' stehen, sind die Stellung und die Abgrenzung des Deutschen in Luxemburg die vorherrschenden Diskursthemen im Zusammenhang mit der Standardisierung des Deutschen. Die folgende Untersuchung widmet sich den zentralen Aspekten der Statusstandardisierung und Korpusstandardisierung (vgl. Deumert/Vandenbussche 2003). Unter Statusstandardisierung wird im Allgemeinen die Entwicklung der sozial-pragmatischen und sozial-symbolischen Stellung sowie die gesellschaftlichen Funktionen einer Sprache verstanden, die über explizite oder implizite sprachenpolitische Maßnahmen gesteuert werden können (vgl. Spolsky 2009). Unter Korpusstandardisierung wird hingegen die sprachsystematische Entwicklung und Vereinheitlichung der linguistischen Struktur verstanden, die in engem Zusammenhang mit der Statusentwicklung steht.
