Security protocols are widely used to ensure secure communications over insecure networks, such as the internet or airwaves. These protocols use strong cryptography to prevent intruders from reading or modifying the messages. However, using cryptography is not enough to ensure their correctness. Combined with their typical small size, which suggests that one could easily assess their correctness, this often results in incorrectly designed protocols. The authors present a methodology for formally describing security protocols and their environment. This methodology includes a model for describing protocols, their execution model, and the intruder model. The models are extended with a number of well-defined security properties, which capture the notions of correct protocols, and secrecy of data. The methodology can be used to prove that protocols satisfy these properties. Based on the model they have developed a tool set called Scyther that can automatically find attacks on security protocols or prove their correctness. In case studies they show the application of the methodology as well as the effectiveness of the analysis tool. The methodology’s strong mathematical basis, the strong separation of concerns in the model, and the accompanying tool set make it ideally suited both for researchers and graduate students of information security or formal methods and for advanced professionals designing critical security protocols. The commission of aggressive wars is now forbidden by both customary and conventional International Law. Additionally, aggression itself constitutes a crime under International Criminal Law. After the Second World War, aggression was universally condemned as the most serious international crime, nonetheless, its definition as a crime was only achieved in June 2010 at the Review Conference of the International Criminal Court. In the preamble of UN Charter, the ‘saving of succeeding generations from the scourge of war’ is set as the cornerstone of the UN’s foundation, however, until 2010, the international community had not achieved (nor had it demonstrated the will to agree on) a legally binding definition of aggression. The research for this dissertation was undertaken as a response to this peculiar finding. This thesis presents the evolution of the definition of aggression through the processes undertaken at the international level (both from the standpoint of state responsibility and of individual criminal responsibility) rather than examining the jus ad bellum, i.e. the requirements for the lawful use of armed force by states. In order to follow the distinction of the definition based on the criterion of liability, the thesis is divided into two main parts. The first part discusses the evolution of the concept of aggression in the context of state responsibility, culminating with the adoption of Resolution 3314 (XXIX) / 12.14.1974 of the General Assembly on the Definition of Aggression. The second part deals with aggression as a crime which carries individual criminal responsibility. It begins at Nuremberg and ends with an analysis of the definitional procedures and of the definition of aggression that was adopted in framework of the International Criminal Court. The analysis of these elements was performed with a combined methodology. A qualitative research method was employed in order to examine the content of different sources. Scarce case-studies were examined for the illustration of the historical events that took place mainly during the early attempts of the international community to denounce war. Additionally, a quantitative research method was used to determine the intent of the international community to define aggression (e.g., how many states voted in favor or against in every definitional procedure) and finally, the utilization of a narrative analysis when referring to historical events. Though the prohibition of aggression represents one of the most important rules of International Law, its application has not yet been fully embedded into the practice of states since they continue to commit aggressive acts, often defining their actions under different legal terms such as ‘self defense.’ Therefore, rather than actually deterring war, the legal rule of the prohibition of aggression has simply contributed to the renunciation of the term as demonstrated by the fact that very seldom do states now declare war officially. As stated eloquently by Benjamin Ferencz, ‘(…) it is seemingly easier to evoke aggression than to dispel it, and easier to commit aggression than to define it (…)’. The thesis concludes that the definition of aggression can and should be implemented as long as the different nature of the international organs that respond to aggression (specifically, the Security Council and the International Criminal Court) is understood. By itself, the prosecution of the crime of aggression by the International Criminal Court will not prevent the commission of wars or other serious international crimes. Nonetheless, in this process that began early last century, the application of the definition of aggression and the prosecution of the crime will still represent a significant accomplishment in humanity’s attempts to prevent and outlaw war. S'exprimant au niveau des sociétés privées (civiles et commerciales), cette question revient à s'interroger sur leur finalité : celles-ci doivent-elle veiller à servir exclusivement les intérêts des associés (shareholders) ou doivent-elles prendre également en compte les autres intérêts (stakeholders) impliqués dans l'aventure sociétaire ? S'agissant plus spécifiquement des sociétés anonymes cotées, cette question pose celle de leur appréhension soit comme un ensemble de titres soumis aux fluctuations des marchés financiers soit comme une entreprise s'inscrivant dans une vision à long terme. Le présent ouvrage se penche sur cette question selon une double perspective : approche pluridisciplinaire : la question est abordée non seulement en droit mais aussi en économie et en sociologie, sans oublier les enseignements de l'histoire ; analyse en droit comparé : le droit des États-Unis, où s'est construite l'approche dite "contractarienne" contemporaine, est tout d'abord comparé au droit français, traditionnellement associé à une approche dite "institutionnelle". Les droits belge, néerlandais, allemand et luxembourgeois sont examinés ensuite. La conclusion de l'ouvrage est que la fonction du droit consiste à préserver l'ouverture de ce débat. En effet tant l'approche contractarienne que l'approche institutionnelle dans leurs versions "pures" aboutissent à une vision absolutiste de la société, laquelle apparaît inconciliable avec le maintien d'un ordre juridique démocratique. Security, risk and compliance are increasingly important issues in enterprise modelling. An analysis of real world scenarios for banking has shown that today's best practices'' based on informal techniques are insufficient and should be replaced by adequate formal approaches. For this purpose, visual enterprise models based on algebraic graph and model transformation are proposed in this thesis, where the following two typical problem areas are considered: (1) Behaviour Analysis and Optimization of Visual Enterprise Process Models (2) Conformance Analysis of Enterprise Process and Service Models The first problem is solved by new concepts and results concerning behaviour analysis of visual languages, especially analysis of permutation equivalence of graph transformations based on Petri nets. In order to tackle the second problem area, model transformations based on triple graph grammars are introduced with new results concerning analysis and optimization enabling automated support for sound integration and conformance checks between different models. The new results in the area of graph and model transformation are developed in the general framework of M-adhesive transformation systems. They can be instantiated to a large variety of high-level replacement systems and applied not only to enterprise modelling, but also to several other application domains. Last but not least, the new tool AGT-M provides automated tool support for simulation, analysis and optimization in various case studies. [less ▲]

The book is a critical legal analysis of the current scope of participation rights in EU law, embedded in the political and institutional contexts of European integration. Participation has featured prominently in recent institutional and political developments that have been shaping the EU's constitutional framework — most intensely in the follow up of the Commission's White Paper on Governance. Yet, little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. Both the EU legislator and the EU Courts have largely ignored this dimension of the rule of law. This book shows why the current judicial and legislative conceptions are inadequate to ensure the legal protection of rights and interests affected by EU regulation. It defends that current conceptions reflect an excessively formalistic approach to participation rights — premised on the right to be heard in individual procedures — as well as a restrictive view regarding the relationships between the citizens and the administration. The book combines a conceptual analysis with an empirical scrutiny of three EU policy fields — food, state aid and financial services — and assesses the scope of participation rights in EU law against their rationales and underlying legal values. It makes a case for the extension of participation rights to new situations and new types of procedures, in particular those that would generally fall within the category of rulemaking. Le traité de Verdun de 843 mit fin à plusieurs années de guerres fratricides entre les trois fils de Louis le Pieux. Il consacra la partition de l’Empire carolingien en trois royaumes : la Francie occidentale et la Francie orientale qui évolueront au cours des siècles pour former respectivement les royaumes de France et de Germanie, encadrant une partie centrale, s’étendant de la Frise à l’Italie, dont hérita Lothaire, l’aîné des fils de Louis le Pieux, également détenteur du titre impérial. L’empereur Lothaire Ier régna pendant douze ans sur cet espace hétérogène, comprenant Aix-la-Chapelle, la « capitale » de Charlemagne et de Louis le Pieux, et s’étendant jusqu’à Rome et aux États pontificaux. Ce royaume dénommé, faute de mieux, « Francie médiane » eut une existence éphémère en tant qu’espace politique unifié car dès le décès de Lothaire (855), il fut scindé en plusieurs entités : les royaumes de Charles de Provence et de Louis d’Italie au Sud, et le royaume de Lothaire II, qui deviendra la Lotharingie, au Nord. Ces trois États entrèrent progressivement dans l’orbite de la Francie orientale, pour devenir parties intégrantes de l’Empire germanique. Le présent volume rassemble les Actes d’un colloque international qui a réuni en février 2006 à Metz, Luxembourg et Trèves des médiévistes, historiens des textes, archéologues et philologues afin d’aborder, dans une perspective interdisciplinaire, l’histoire politique, institutionnelle, économique et sociale de la Francia Media, espace central européen. In the Middle Ages and early modern times, leprosy was a widespread disease. Leprosories served for the special accommodation of leprosy patients. In the Rhineland, a total of 190 leprosories can be documented from the first documentary mention of a leprosarium in 1180 until the extinction of leprosy in the 18th century. The study is focused on questions concerning the economic, social and organisational development status of these institutions. In addition, the living habits of leprosy patients as well as their legal and social status are also in focus. Finally, the question of the decline of leprosy and the final disappearance of the disease at the beginning of the 18th century is investigated. Above all, the consequences of the decline will be examined in more detail, first under-occupancy, then decay, dissolution or misappropriation of leprosories. A large-format map is used to analyse the results in terms of their spatial reference, allowing a chronologically differentiated picture of leprosories in the Rhineland between the 12th and 18th centuries. This book is divided into three main parts, dealing with historical narration, territory and language. Historical narrations have played a key role in ‘inventing’ national, gendered, ethnic and racial identities, and in presenting deterministic and essentialist conceptions of time and human action. The importance of (abstract and social) space in the production of history and the equal importance of the temporal dimension in the production of geography have been underlined by Doreen Massey. Her concept of ‘space/time’ abolishes the binary opposition of time and space and defines them as interrelated.This double process of spatial and temporal construction of identity is analysed here in a diachronic way from the late nineteenth to the early twenty-first century, comprising the period traditionally considered as key to nation-building processes as well as current trends towards de-and renationalisation. The scale of this study is limited to discourse in Luxembourg and concerns the production of internal and external borders. Part One retraces the ‘genealogy’ of the master narrative from the early modern period and examines its absorption into public expressions of political self-identity after 1919. It then looks at the dissemination of the master narrative by means of textbooks, celebrations, literature and popular culture. Finally, it highlights the transformations of this narrative, the opening of fields of possibilities and new trends. Part Two examines how representations of space complement the master narrative by embedding past experiences in a certain territory and within certain defined borders. Territorial delimitations are projected back in time and legitimised by reference to the same bounded space in the past. Two different discursive strategies for the creation of ‘collective identity’ are distinguished: the centripetal and the centrifugal. The former characterises the national master narrative, while the latter has more of a supranational, Great Regional or European focus. Part Three traces the evolution of Luxembourgish, which still is in full nationalisation mode. Once again, the watershed here seems to have come in 1919, when the language began to be seen not as a mere dialect of German, but as a distinctly different tongue. On first sight, a native language seems to be a constant of human existence, in the sense both of history and of an individual’s life. As its title indicates, however, this book seeks to deconstruct the notion of a natural language and focuses on the act of creation and on the social actors involved in this process. The evolution of the language is, moreover, placed in a broad context. Th e gradual codification of Luxembourgish was part of a larger movement which aimed to give the comparatively young state a sense of substance and meaning. As in most European nationstates, the state of Luxembourg existed before any systematic attempts at nation-building were undertaken. It was—and still is—heavily involved in this process. Thus, in recent years, Luxembourg has created new national institutions, such as the Central Bank in 1998, the University of Luxembourg in 2003, and the establishment of several Luxembourg-related research institutes between 1995 and 2008. This book investigates whether this nationalisation tendency may be confirmed by the study of the representations of the past, the territory and the language from the mid-nineteenth century to the present day.
