Denis Scuto has written a foreword for the catalogue of the exhibition realised by writer Claude Frisoni and photographer Raymond Reuter on the history of the antifascist Italian mining workers in the ARBED mine Montrouge overlapping the French-Luxembourgish frontier and their persecution during Nazi occupation, also presenting the testimonies of some of their children and grand-children: Norbert and Roland Rutili, sons of Vittorio Rutili, arrested by Gestapo on February 3 1944, killed in concentration camp of Schorzinger (Struthof), Raymond Peruzzi, son of Luigi Peruzzi, arrested by Gestapo on September 9 1942, deported to SS-camp Hinzert (near Trier) and forced labourer for Siemens in Berlin, Aurélie Filippetti, grand-daughter of Tommaso Filippetti, arrested by Gestapo on February 3 1944 and who died in concentration camp of Bergen-Belsen on April 12 1945, Jean-Pierre Barboni, grand-son of Domenico Bordicchia, arrested on October 23 1942 and deported to Hinzert and Ventotene. The history of Poles in Luxembourg after the re-establishment of the new Polish state in 1918 can be traced on the basis of statistics from various sources. The Polish Ministry of Foreign Affairs kept statistics that provide a picture of Polish labour migration between two world wars. Luxembourg historians have also tackled the question of the image of the Polish diaspora before its members started to assimilate. However, both the period of World War I and the years before are hardly recorded due to the nationality of the Polish diaspora who came to Luxembourg as German, Austrian or Russian citizens. Their number should be noticeable from as early as 1900 though. On the one hand, the Luxembourg steel industry boomed at those times, which had to fall back on labour from foreign workers. On the other hand, Polish workers have a long tradition of workers “export”, because the temporary Polish migrants worked in the smelters of the German Ruhr area. They were also in demand (and engaged) in Luxembourg from 1900 to 1920. [less ▲]

Frente al paradigma de que la justicia contractual constituye un bien público, el autor sostiene que se ha generado durante los últimos años un proceso de reivindicación en el cual el arbitraje retorna y viene a reclamar un terreno que le pertenece: la resolución de las controversias comerciales. Las personas han notado las ineficiencias del Poder Judicial y se han dado cuenta de que el arbitraje es una mejor elección. Como muestra de ello, en los contratos comerciales relevantes lo usual es pactar un arbitraje. Hoy en día es difícil hallar un contrato importante que no incorpore una cláusula arbitral. En esa línea resulta curioso que muchas veces se considere al arbitraje como un mecanismo alternativo de resolución de conflictos. Y es que se trata de cualquier cosa menos de un mecanismo alternativo. Para el autor, el arbitraje se ha convertido en el mecanismo natural de resolución de controversias comerciales. Fácticamente es la regla, y como tal no puede ser una alternativa. En el marco de este de proceso de reivindicación espontánea, el autor propone consagrar al arbitraje como la “default jurisdiction” (o jurisdicción por defecto) para todas las controversias de carácter patrimonial. En un mundo como el que vivimos el arbitraje ha llegado, y ha llegado para quedarse. [less ▲]

Définir ce dont le Parlement est le nom suppose ainsi de multiplier les focales – ce que la spécialisation de la recherche et l’éparpillement des connaissances rendent aujourd’hui malaisé. Face à un tel défi, ce volume collectif a l’ambition de proposer une revue des savoirs contemporains relatifs au Parlement qu’ils relèvent des sciences sociales ou juridiques. Il regroupe les contributions des meilleurs spécialistes francophones ou internationaux qui présentent la façon dont leur discipline académique envisage l’objet Parlement. Au cours des dernières années le visage de la coopération judiciaire internationale a été bouleversé. Il en est ainsi notamment en matière civile et commerciale. L’actualité atteste de l’existence de pratiques qui étaient difficilement imaginables autrefois. Aujourd’hui, la coopération entre juges de common law va au-delà des seuls aspects opérationnels des procédures. En effet, les cas de juges coopérant pour résoudre les problématiques substantielles posées par des procédures parallèles ou connexes sont de plus en plus fréquents. À cette fin, ces juges ont recours à des méthodes peu orthodoxes, comme le dialogue, la communication par différents moyens, ou encore la négociation. Certains s’accordent même sur la voie à suivre. Cet ouvrage étudie les accords de coopération entre juges étatiques destinés à résoudre ce type de problématiques. Ces accords, qui surgissent notamment en matière d’insolvabilité (crossborder insolvency protcols) et d’enlèvement d’enfants, ne se présentent cependant pas dans des formes connues ou convenues. L’analyse des différents exemples démontre que si certains n’ont pas pour ambition de produire des effets de droit, d’autres peuvent être qualifiés de contrats. Un contrat de coopération entre juges conclu dans le cadre d’une affaire donnée soulève naturellement une multitude de questions inédites et fondamentales. Cette étude propose des réponses à certaines de ces questions. Prenant comme point de départ la pratique des juges de common law, elle se concentre sur le point de vue du droit continental et offre une première analyse du phénomène. L’ouvrage s’adresse aux praticiens exerçant une activité contentieuse internationale de droit privé et au législateur, qui pourra s’en inspirer pour promouvoir ce mode de coopération judiciaire. Il est également destiné aux chercheurs aussi bien de droit civil que de common law s’intéressant à la coopération judiciaire internationale et plus largement aux rapports entre juges étatiques. Il leur permettra de découvrir ou de mieux connaître une pratique peu recensée, ainsi que d’approfondir les questions théoriques qu’elle soulève en tant que phénomène se trouvant à la charnière aussi bien du droit public et du droit privé, que du droit international et national.
