Annotated Legal Documents on Islam in Luxembourg consist of an annotated book of currently valid legal documents affecting the status of Islam and Muslims in Luxembourg. By legal documents are meant the texts of legislation, including relevant secondary legislation, as well as significant court decisions. Each legal text will be preceded by an introduction describing the historical, political and legal circumstances of its adoption, plus a short paragraph summarising its content. The legal texts will be published in the original language while the annotations and supporting material will be in English. The focus of the book is on the religious dimensions of being Muslim in Luxembourg, i.e. on individuals' access to practise their religious obligations and on the ability to organise and manifest their religious life. It's a part of a project will cover the 28 member states of the European Union (including Croatia), Norway and Switzerland plus the European Union and the European Court of Justice. [less ▲]

Depuis les référendums sur le feu Traité constitutionnel européen en 2005 et suite au déclenchement de la crise de la dette souveraine d’Etats membres de la zone euro en 2009, la confiance accordée par les citoyens à l’Union européenne et aux gouvernements qui la composent s’affaiblit. Le scrutin pour désigner le nouveau Parlement européen en mai 2014 a confirmé ce « réalignement électoral » au profit de forces politiques qui sont classées et/ou qui se considèrent parfois elles-mêmes comme relevant du « populisme ». Ce rapport de force inédit nous oblige à traiter « à nouveaux frais » de l’identité des populismes et de leurs rapports à la démocratie d’autant plus qu’ils aspirent désormais, s’ils ne l’ont pas déjà fait, à exercer des fonctions gouvernementales. Bien plus, il n’existe aucune théorie politique qui ne se réfère directement ou indirectement à l’égalité ou à l’inégalité à un point tel qu’on puisse dire que, dans la plupart des cas, du moins depuis les Révolutions américaine et française, la justice d’un ordre social et politique se traduit par l’égalité ou l’inégalité entre ses membres. D’où la controverse qui entoure son usage dans les contextes sociaux et politiques. C’est à juste titre qu’on a pu dire que la justice représente un “essentially contested concepts”.1 Néanmoins, même en politique, ce ne sont pas toutes les occurrences ou emploi du terme égalité ou inégalité qui devraient donner lieu à des contestations. The book "Women, Gender and Computing (from the 1940s to today)" analyses how the role of women in computing has evolved in the US and Europe. It studies how this field became more and more a masculine domain. This anthology is structured in three parts. The first one focused on (In)Visibility through time, highlighting women's important role in the early years of computing. It enlightens the evolution of their role, first as human computers or punch cards operators, until the strong professionalization of the sector, and showcases their invisibility through time. The second part, on users and gendered representations, shows how the field of computing has been clearly centered around men, may it be through advertising or national policies. The third part is focused on empowerment, appropriation, and activism, starting with the first pioneering women in the software industry, such as Elsie Shutt in the 1950s and Stephanie "Steve" Shirley in the 1960s. On the most actual trends, this part includes different initiatives to encourage women into coding, gaming, and computing as a whole. This Living book mixes historical, sociological, and anthropological approaches, abandoning restrictive outlooks on computing science as a solely programming-centered field. The increased complexity of international tax rules since the inception of the BEPS project created the need for alternative dispute resolution. This realisation has led both the international community and European Union institutions to expand on the possibilities for intergovernmental mechanisms to address diverging interpretation of treaty rules by tax administrations in treaty partner states. These give rise to many questions on the implementation and integration of the new rules into domestic (court) procedures, their correct interpretation, and best practices in their application by tax officials, lawyers and arbitrators. This book addresses these questions in a holistic manner, starting with a comprehensive analysis of existing tax treaty norms and their practical application in MAP and arbitration procedures (Chapters 1–4). In its second part, it offers a timely expert analysis of primary and secondary EU law rules on tax dispute resolution, detailing the specifics of Directive 2017/1852 as well as their interaction with EU general principles, fundamental rights and internal market norms (Chapters 5–6). Next, Chapters 7–9 consider the taxpayer’s position in the primarily administrative dispute resolution process, focussing on taxpayer rights, the domestic legal remedies relevant to the implementation and review of MAPs and the merits of mediation as a tool for taxpayers to resolve disputes with tax administrations. Finally, the fourth part of this book (Chapters 10–13) considers the relevance for tax disputes of mechanisms found in trade and investment law, both as a source of insight for the improvement of tax-specific procedures and as mechanisms that can be applied directly to tax disputes. The creation of 39 Mixed Arbitral Tribunals (‘MATs’) was a major contribution of the post-World War I peace treaties to the development of international adjudication. With over 90 000 claims handled, the MATs were the busiest international courts of the interwar period. Moreover, in a departure from most other international courts and tribunals at that time, they allowed individuals to file claims against sovereign states before them. After 1945, they inspired the creators of the European Court of Justice before disappearing into quasi-oblivion. Like most school subjects and their respective mother sciences and research areas, physical education faces severe challenges caused by recent political and social developments. Due to the implementation of international guidelines and increased immigration, inclusion and intercultural learning, as well as corresponding teacher training, will be critical issues for the educational sciences in general and for physical education in particular. This applies also to the use of new information and communication technology. How, how often, under what conditions and for what purpose should tools such as tablets, software apps and activity trackers be used by physical education teachers and other physical activity educators and practitioners? What are the benefits and the risks? However, the most relevant problem the field of physical education and physical activity is currently confronted with is the changing physical activity behaviour of children and youth, particularly in developed countries. A joint effort of researchers, educationalists, politicians, and teachers is needed to determine the causes of young people’s physical inactivity and develop effective strategies and programmes that can be implemented in school as well as community settings in general. At the 4th CIAPSE Congress in Luxembourg, leading researchers and educationalists from all over Europe addressed these challenges and developments and presented innovative concepts. This open access book focuses on migrant and minority cemetery needs through the conceptual lens of the mobilities of the living and the dead. In doing so, the book brings migration and mobility studies into much-needed dialogue with death studies to explore the symbolically and politically important issue of culturally inclusive spaces of cemeteries and crematoria for migrants and established minorities. The book addresses majority and minority cemetery and crematoria provisions and practices in a range of North West European contexts. It describes how the planning, management and use of cemeteries and crematoria in multicultural societies can tell us about the everyday lived experiences of migration and migrant heritage, urban diversity, social inclusion and exclusion in Europe, and how these relate to migrant and minority experience of lived citizenship, practices of territoriality and bordering, colonial/postcolonial narratives. The application of digital technologies to historical newspapers have changed the research landscape historians were used to. An Eldorado? Despite undeniable advantages, the new digital affordance of historical newspapers also transforms research practices and confronts historians with new challenges. Drawing on a growing community of practices, the impresso project invited scholars experienced with digitised newspaper collections with the aim of encouraging a discussion on heuristics, source criticism and interpretation of digitized newspapers. This volume provides a snapshot of current research on the subject and offers three perspectives: how digitisation is transforming access to and exploration of historical newspaper collections; how automatic content processing allows for the creation of new layers of information; and, finally, what analyses this enhanced material opens up. ‘impresso - Media Monitoring of the Past’ is an interdisciplinary research project that applies text mining tools to digitised historical newspapers and integrates the resulting data into historical research workflows by means of a newly developed user interface. The question of how best to adapt text mining tools and their use by humanities researchers is at the heart of the impresso enterprise. [less ▲]

Am 17. April 2022 vollendete Dieter Dörr sein 70. Lebensjahr. Mit der vorliegenden Festschrift würdigen die Autorinnen und Autoren den Jubilar und gratulieren ihm herzlich. Dieter Dörrs Wirken ist geprägt vom Freiheitsbegriff des demokratischen Verfassungsstaats. In seiner Abschiedsvorlesung an der Johannes Gutenberg-Universität brachte er unter dem Titel „Die Freiheit, die ich meine“ nachdrücklich seine Überzeugung zum Ausdruck, dass Freiheit und Verantwortung einander bedingen. Die Umsetzung seiner Überzeugung in das einfache Recht und in die Praxis sind ein Anliegen des Jubilars, das sich in seinem Oeuvre und in den Beiträgen zu dieser Festschrift widerspiegelt. Hinzu kommt sein vertieftes Interesse am Ineinandergreifen und Zusammen- wirken unterschiedlicher Rechtsordnungen. Inhaltlich ist das weitere wissenschaftliche und praktische Wirken des Jubilars in besonderer Weise mit dem Medienrecht verbunden. Sein Name steht für die fruchtbare Verbindung von Wissenschaft und Praxis, und seine klaren Aussagen haben die medienrechtliche und medienpolitische Debatte nachhaltig geprägt. [less ▲]

Global pandemics, devastating wars and natural disasters with increasing frequency and impact are disrupting previously carefully balanced manufacturing networks. All industrial companies are required to examine their operations and adjust accordingly. The increasing cost of resources require enterprises to re-design their value creation processes to be more sustainable, to optimize the supplier network to become more resilient and to accelerate digitizing of operations to enhance operational effectiveness. This year's WGAB research seminar is themed around Digitization of the work environment for sustainable production and seeks to contribute solutions to the current challenges. The scientific discourse aims to advance the sustainable and data-based organization of value creation processes. Exemplary efforts for the sustainable production of 3D printed footwear and the circular supply chain of energy production will be discussed. With advances in sensory data collection in cyber-physical production systems (CPPS), there are new opportunities for sensing the status of manufacturing systems, which enable advanced data analytics to contribute to a sustainable production. Intelligent processes enable sustainable value creation and bi-directional knowledge exchange between humans and machines. With people at the centre of the CPPS, production systems shall be both adaptive and personalized for every worker. People need to be involved in the technological and organizational changes. Simulating the migration from a linear economy to a circular economy supports the trend of regionalized production networks. Digital assistance systems are tested to back up resilient manufacturing. We would like to thank all authors for their efforts in preparing the contributions, which are valuable inputs to the discourse to solve the current challenges. [less ▲]

Im September 2020 ist es soweit: Der neue Medienstaatsvertrag löst den bisherigen Rundfunkstaatsvertrag ab. Er bedeutet nicht weniger als eine umfassende Neuregulierung der elektronischen Medien. Auch die Vorschriften zur Aufsicht erfahren umfangreiche Neuregelungen. Insgesamt lassen sich im Vergleich zum Rundfunkstaatsvertrag erhebliche Änderungen sowohl in der Systematik als auch in vielen Details verzeichnen. Der Medienstaatsvertrag trägt damit technischen Entwicklungen ebenso Rechnung wie der Umsetzung von neuen Vorgaben auf unionaler Ebene. Überarbeitet und geändert wurden Regelungen zum Rundfunkbegriff- und Zulassungsvorschriften sowie die Plattformregulierung. Teilweise völlig neu oder mindestens erheblich geändert sind die Abschnitte zu neuen Medienformen und -plattformarten, zu "Medienintermediären", "Benutzeroberflächen" und "Video-Sharing-Diensten". Unser Standardwerk zum bisherigen Rundfunkstaatsvertrag sowie Jugendmedienschutzstaatsvertrag trägt diesen weitreichenden Änderungen Rechnung und wird zum Heidelberger Kommentar Medienstaatsvertrag Jugendmedienschutz-Staatsvertrag. This book focuses on the enforcement aspect of tobacco control policy, and argues that the intense regulation of the tobacco market will never be successful as long as it can be circumvented by the availability of illicit tobacco products. Yet, current efforts to combat illicit tobacco trade are insufficient, suffering from several flaws and gaps at the regulatory and operational levels. The aim of this book is to provide an analysis of the legal framework and practice of enforcement with regard to illicit tobacco products. Combining criminological and legal perspectives, it presents and critically analyses the phenomenon of illicit tobacco trade, as well as the policies, legal frameworks and practices in six EU countries with regard to combatting this phenomenon, assessing the strengths and weaknesses of their approaches. Furthermore, it studies the relationship between the EU and third countries (e.g. Ukraine) in terms of how the EU can influence policy and enforcement in these countries in order to counter illicit tobacco trafficking. Not exclusively focusing on the EU, the book also includes an analysis of enforcement against illicit tobacco products in the US. The EU Member States analysed in the book (Belgium, Germany, Italy, Latvia, the Netherlands and Poland) reflect the range of currently available approaches. Some of them have ratified the WHO Protocol against tobacco smuggling; others have not. They belong to different legal traditions and face different challenges due to their respective border situations. While Belgium and the Netherlands are key entry ports to the EU, Poland and Latvia represent the Eastern land border of the EU, with various regional challenges. Italy has a long maritime border, where trafficking is possible from Northern Africa and from the Middle East. It also has significant experience in fighting organised crime. Lastly, Germany is the largest market in Europe and situated in the middle of these trafficking routes. [less ▲]

As a result of rapid advancements in computer science during recent decades, there has been an increased use of digital tools, methodologies and sources in the field of digital humanities. While opening up new opportunities for scholarship, many digital methods and tools now used for humanities research have nevertheless been developed by computer or data sciences and thus require a critical understanding of their mode of operation and functionality. The novel field of digital hermeneutics is meant to provide such a critical and reflexive frame for digital humanities research by acquiring digital literacy and skills. A new knowledge for the assessment of digital data, research infrastructures, analytical tools, and interpretative methods is needed, providing the humanities scholar with the necessary munition for doing critical research. The Doctoral Training Unit "Digital History and Hermeneutics" at the University of Luxembourg applies this analytical frame to 13 PhD projects. By combining a hermeneutic reflection on the new digital practices of humanities scholarship with hands-on experimentation with digital tools and methods, new approaches and opportunities as well as limitations and flaws can be addressed. The latest advances in several emerging technologies such as AI, blockchain, privacy-preserving algorithms used in localization and positioning systems, cloud computing and computer vision all have great potential in facilitating social distancing. Benefits range from supporting people to work from home to monitoring micro- and macro- movements such as contact tracing apps using Bluetooth, tracking the movement and transportation level of a city and wireless positioning systems to help people keep a safe distance by alerting them when they are too close to each other or to avoid congestion. However, implementing such technologies in practical scenarios still faces various challenges. This book aims to lay the foundations of how these technologies could be adopted to realize and facilitate social distancing to better manage pandemics and future outbreaks. Starting with basic concepts, models and practical technology-based social distancing scenarios, the authors present enabling wireless technologies and solutions which could be widely adopted to encourage social distancing. They include symptom prediction, detection and monitoring of quarantined people and contact tracing. In the future, smart infrastructures for next-generation wireless systems should incorporate a pandemic mode in their standard architecture and design. [less ▲]

Assemblies are ancestral, transcultural ways of coming together as a community. Over the past decades, multiple social movements have reappropriated these forms of collective organisation as a prominent component of political struggle, to defend radical visions of democracy. At the same time, governments across the globe have sought to reframe public deliberation as a response to the failures of representative democracy. How can we analyze this double movement, and could assemblies of equals once again offer possibilities to reimagine and renew the ways politics is practiced? To address these questions, we need to move beyond simply asking what assemblies can do, and instead examine how they are made. This means departing from the shores of a speculative, deliberative ideal and restoring attention to both their diversity of forms, and their capacities to perform, deform, and transform. Bringing together accounts written by those who practice assemblies, and contributions from artists, activists, historians, philosophers, and social scientists, as well as three architectural experiments that attempt to imagine models for a future assembly, the book proposes a critical inquiry into the potential of assemblies to shape political subjects. From assemblies in Indigenous territories of Brazil to those of the Yellow Vests in France, from medieval communes to street parliaments in Africa, from citizens’ assemblies set up by public authorities to practices forged from emancipatory traditions, What Makes An Assembly? examines the tensions that exist in all assemblies between the need for form and the danger of formalization; between the scripts, rituals, and architectural settings from which they derive, and their capacity to erupt and emerge anew. As media environments and communication practices evolve over time, so do theoretical concepts. This book analyzes some of the most well-known and fiercely discussed concepts of the digital age from a historical perspective, showing how many of them have pre-digital roots and how they have changed and still are constantly changing in the digital era. Written by leading authors in media and communication studies, the chapters historicize 16 concepts that have become central in the digital media literature, focusing on three main areas. The contributions to this book examine the two main asymmetries of the Euro Area as they have intensified during the second decade of Economic and Monetary Union (EMU): the first between monetary union (more supranational governance) versus ‘economic’ union (less centralised governance); the second between those Euro Area member states of the so-called ‘core’ and those of the ‘periphery’. EMU stands as one of the European Union’s (EU) flagship integration achievements. Set up in 1999, with the large majority of EU member states at the time, EMU was described as ‘asymmetrical’ even prior to its start. From the outset, it involved asymmetrical integration in monetary and ‘economic’ union. Although a major element of the blueprint that paved the way for the final stage of EMU, the concept of ‘economic’ union was insufficiently developed. The second decade of the single currency gave rise to a second asymmetry, namely one between those Euro Area member states of the ‘core’ and those of the ‘periphery’. The ten contributions to this volume speak to one or both of these asymmetries, covering the major political, political economy and policy dimensions of EMU and the ongoing debates about necessary policy and institutional reforms to overcome these asymmetries and bolster Euro Area stability. The suggestion to “align international taxation with value creation” first emerged in the context of the OECD BEPS Project aimed at tackling aggressive tax planning strategies resulting in base erosion and profit shifting. The concept of “value creation” was then further relied on in the broader discussion that followed about the impact of digitalization on the global economy generally and the fair allocation of taxes between countries in this new environment. Although the idea – or the guiding principle – that profits should be taxed where economic activities occur and where value is expected to be created initially received a relatively large support, it rapidly became clear (at least to academics) that there would be no obvious answer to the question “where is value being created?” in a manner that would be relevant for (international) tax purposes, inter alia in view of the different models of value creation within corporate entities. Based on 9 thematic reports (offering an interdisciplinary discussion of the concept of value creation mostly from an international perspective) and on 23 national reports (focusing on the meaning of value creation in domestic tax law), this book seeks to contribute to the discussion on whether the concept of value creation is viable, both theoretically and in practice, as a criterion for the allocation of taxing rights under a modernized international tax framework. “You never knew. That was his power.” These words, which picture Keyser Söze in The Usual Suspects (1995), also describe a specific mode of action typical of evil protagonists in popular culture of the 20th and 21st centuries, namely their non-appearance. One can indeed distinguish several types of evil in popular culture: on the one hand, the representatives of the “other” in the sense of a political enemy (the stereotypical character of the Nazi, the Communist, the Arab terrorist, etc.); on the other hand, the figure of the faceless, disguised, not (stereotypically) apparent evil. The secret organization that James Bond fights against in several films is significantly named “Specter”. Similarly, Lord Voldemort remains faceless and ghostlike in the Harry Potter series. These figures do not represent the “other” as a clearly identifiable political antagonist, but an “other other” whose unknowability and namelessness are an essential part to his or her power and (non-)identity. The “bad guys” can always be interpreted as reflections of a political order: by not adhering to the moral, social, and political rules of the community, they reflect on the contingency of these rules and may also try to enforce alternative models of coexistence through violence. It would therefore be interesting to ask to what extent the faceless figure of evil represents a political model without being clearly identified to a political or ideological “other”? In the context of media diversity in popular culture in the 20th and 21st centuries, the portrayal of faceless figures of evil produces an equally wide variety of aesthetic manifestations. The question of the representations of evil thus necessarily exists at the interface between politics and poetics. This issue of Cultural Express wants to examine this interface in popular and youth literature, fantasy, science-fiction, horror, crime fiction, movies, TV series, songs, comics, graphic novels, video games, etc. [less ▲]

Le nouveau Code des sociétés et des associations, introduit par le législateur belge en 2019 et applicable aux sociétés existantes depuis le 1er janvier 2020, est-il un exemple qui ferait sens au Luxembourg ?
