By legal documents are meant the texts of legislation, including relevant secondary legislation, as well as significant court decisions. Each legal text will be preceded by an introduction describing the historical, political and legal circumstances of its adoption, plus a short paragraph summarising its content. The legal texts will be published in the original language while the annotations and supporting material will be in English. The focus of the book is on the religious dimensions of being Muslim in Luxembourg, i.e. on individuals' access to practise their religious obligations and on the ability to organise and manifest their religious life. It's a part of a project will cover the 28 member states of the European Union (including Croatia), Norway and Switzerland plus the European Union and the European Court of Justice. [less ▲]

The European Union is a union under the rule of law and accordingly all exercise of public authority needs to conform with the principle of legality. The legal framework of the EU is, however, as much as that of any state or international organization, subject to change over time. That part of this legal framework specifically governing EU administration has been particularly dynamic. The central reason for this dynamism is to be found in the evolving nature of European integration, and in the changing requirements and conditions for implementing EU policies. The legal framework of administration has been both the subject of, and a response to, change in the ambient political and institutional environment. The EU, having started as an organization of six Member States focused on economic integration, has evolved into a Union of twenty-seven Member States now touching almost all elements of the exercise of public power in a modern society. The evolutionary development of the constitutional basis of EU law, with its many phases of Treaty reforms and change induced by case-law, finds its parallel in EU administrative law. European administrative law has in this process grown, changed, and indeed matured over time, and has emerged as an important, yet sometimes not well understood, factor which materially shapes policy in the EU and its achievement in reality. The rise of the importance of EU administrative law is itself attributable both to the specificities of European integration and to the general increase in the importance of administrative regulation in the past decades. On the one hand, the protection of the society against risks associated with private activity such as banking, food production, energy production and distribution, transport, or activities threatening to the environment, to name just a few, and the achievement of a balance between their benefits and dangers have become increasingly important subjects of attention. On the other hand, the provision of services and infrastructure necessary to ensure and protect basic standards of living such as pensions, health care, access to water, energy supply and telecommunications services have been the subject of mixed regimes, often still having a strong public service element, but increasingly left to private provision subject to various levels of market regulation. Both kinds of motivation for regulatory measures and their implementation by appropriate authorities have added to, and substantially changed, the broad character of public administration in Europe in recent decades. Such changes have occurred not just on a national, that is, Member State level, but also, pre-eminently, on the level of the European Community and now Union. Indeed, many of the changes have themselves been triggered on the European level as integral or at least adjuvant elements of the establishment of the European internal market. The role, then, of administrative law and administrative activity on the European level is extensive and important. Rules and principles governing the exercise of administrative functions, the organization of the institutions and bodies exercising these functions, and applicable procedures are the essence of EU administrative law. These are the subject of this book. There are, it must be observed, many perspectives from which one can view, analyse and comprehend both administration and administrative law. Three models or perspectives appear to us to be particularly helpful: administration and administrative law may be usefully considered from functional, organizational, and procedural standpoints. The functional aspect of administration refers to the totality of the tasks of administration, no matter who undertakes them and how they are carried out. The organizational perspective emphasises the organization and structure of the institutions, bodies, and actors engaged in undertaking such tasks. Finally, a procedural understanding of administration observes the processes which link the various actors and authorities in the performance of administrative functions. None of these models standing alone provides a fully rounded understanding or conceptualisation of the subject matter of the book. A proper analysis of EU administrative law cannot view it from only one of these perspectives. Taken together, however, these three standpoints do offer a comprehensive perception, giving the subject a more multi-dimensional shape, and thus allowing a more tractable presentation of what is very complex material. For this reason, we offer a discussion of each of these three perspectives — the functional, organizational, and procedural aspects of European Union administration and the associated legal framework — by way of introduction. The three models are, of course, closely interlinked and in reality scarcely separable but, for analytical and presentational clarity, they are here addressed separately. [less ▲]

The increased complexity of international tax rules since the inception of the BEPS project created the need for alternative dispute resolution. This realisation has led both the international community and European Union institutions to expand on the possibilities for intergovernmental mechanisms to address diverging interpretation of treaty rules by tax administrations in treaty partner states. These give rise to many questions on the implementation and integration of the new rules into domestic (court) procedures, their correct interpretation, and best practices in their application by tax officials, lawyers and arbitrators. This book addresses these questions in a holistic manner, starting with a comprehensive analysis of existing tax treaty norms and their practical application in MAP and arbitration procedures (Chapters 1–4). In its second part, it offers a timely expert analysis of primary and secondary EU law rules on tax dispute resolution, detailing the specifics of Directive 2017/1852 as well as their interaction with EU general principles, fundamental rights and internal market norms (Chapters 5–6). Next, Chapters 7–9 consider the taxpayer’s position in the primarily administrative dispute resolution process, focussing on taxpayer rights, the domestic legal remedies relevant to the implementation and review of MAPs and the merits of mediation as a tool for taxpayers to resolve disputes with tax administrations. Finally, the fourth part of this book (Chapters 10–13) considers the relevance for tax disputes of mechanisms found in trade and investment law, both as a source of insight for the improvement of tax-specific procedures and as mechanisms that can be applied directly to tax disputes. With over 90 000 claims handled, the MATs were the busiest international courts of the interwar period. Moreover, in a departure from most other international courts and tribunals at that time, they allowed individuals to file claims against sovereign states before them. After 1945, they inspired the creators of the European Court of Justice before disappearing into quasi-oblivion. Like most school subjects and their respective mother sciences and research areas, physical education faces severe challenges caused by recent political and social developments. Due to the implementation of international guidelines and increased immigration, inclusion and intercultural learning, as well as corresponding teacher training, will be critical issues for the educational sciences in general and for physical education in particular. This applies also to the use of new information and communication technology. How, how often, under what conditions and for what purpose should tools such as tablets, software apps and activity trackers be used by physical education teachers and other physical activity educators and practitioners? What are the benefits and the risks? However, the most relevant problem the field of physical education and physical activity is currently confronted with is the changing physical activity behaviour of children and youth, particularly in developed countries. A joint effort of researchers, educationalists, politicians, and teachers is needed to determine the causes of young people’s physical inactivity and develop effective strategies and programmes that can be implemented in school as well as community settings in general. At the 4th CIAPSE Congress in Luxembourg, leading researchers and educationalists from all over Europe addressed these challenges and developments and presented innovative concepts. The application of digital technologies to historical newspapers have changed the research landscape historians were used to. An Eldorado? Despite undeniable advantages, the new digital affordance of historical newspapers also transforms research practices and confronts historians with new challenges. Drawing on a growing community of practices, the impresso project invited scholars experienced with digitised newspaper collections with the aim of encouraging a discussion on heuristics, source criticism and interpretation of digitized newspapers. This volume provides a snapshot of current research on the subject and offers three perspectives: how digitisation is transforming access to and exploration of historical newspaper collections; how automatic content processing allows for the creation of new layers of information; and, finally, what analyses this enhanced material opens up. ‘impresso - Media Monitoring of the Past’ is an interdisciplinary research project that applies text mining tools to digitised historical newspapers and integrates the resulting data into historical research workflows by means of a newly developed user interface. The problem of banks being 'too big to fail' was the defining regulatory issue of the global financial crisis. However, attempts to tackle the problem by separating retail banking from higher risk trading activities - known as structural reform - proved to be highly divisive and contributed to significant regulatory divergence. In this book, David Howarth and Scott James explain this variation by examining the politics of bank structural reform across six key jurisdictions: the United States, the European Union, the United Kingdom, France, Germany, and the Netherlands. Integrating political economy and public policy approaches, they develop a novel 'comparative financial power' framework to analyse how financial industry influence is mediated by two factors: first, whether bank lobbying is unified and centralized (cooperative financial power) or divided and fragmented (competitive financial power); and second, policy makers' use of venue shifting to depoliticize contentious policy issues. The book explains that the US and UK governments implemented major reforms because the banking industry was divided and faced significant opposition. However, venue shifting to an independent committee led to durable reform in the UK, while political polarization in the US contributed to contested reform. By contrast, the French and German governments balanced unified bank lobbying and political pressures to act by pursuing limited symbolic reforms; the Dutch government deflected the issue through delegation to multiple commissions (no reform); while political stalemate at the EU level resulted from early venue shifting and concerted pan-European bank lobbying. The book makes a major contribution to scholarship on the political economy of finance and business power. [less ▲]

Tous ont eu la certitude de suivre les cours d’un grand prof ! Au moment même où Sylvain Schirmann fait valoir ses droits à la retraite, ses anciens thésards ont voulu lui rendre hommage à travers ce volume collectif investissant des thèmes qui lui sont chers. La quinzaine de contributions réunies ici s’ouvre sur l’itinéraire de cet historien passionné, rappelée par Marie-Thérèse Bitsch. Global pandemics, devastating wars and natural disasters with increasing frequency and impact are disrupting previously carefully balanced manufacturing networks. All industrial companies are required to examine their operations and adjust accordingly. The increasing cost of resources require enterprises to re-design their value creation processes to be more sustainable, to optimize the supplier network to become more resilient and to accelerate digitizing of operations to enhance operational effectiveness. This year's WGAB research seminar is themed around Digitization of the work environment for sustainable production and seeks to contribute solutions to the current challenges. The scientific discourse aims to advance the sustainable and data-based organization of value creation processes. Exemplary efforts for the sustainable production of 3D printed footwear and the circular supply chain of energy production will be discussed. With advances in sensory data collection in cyber-physical production systems (CPPS), there are new opportunities for sensing the status of manufacturing systems, which enable advanced data analytics to contribute to a sustainable production. Intelligent processes enable sustainable value creation and bi-directional knowledge exchange between humans and machines. With people at the centre of the CPPS, production systems shall be both adaptive and personalized for every worker. People need to be involved in the technological and organizational changes. Simulating the migration from a linear economy to a circular economy supports the trend of regionalized production networks. Digital assistance systems are tested to back up resilient manufacturing. Book Description The second edition of Public History: A Textbook of Practice offers an updated guide to the many opportunities and challenges that public history practitioners can encounter in the field. Historians can play a dynamic and essential role in contributing to public understanding of the past, and those who work in historic preservation, in museums and archives, in government agencies, as consultants, as oral historians, or who manage crowdsourcing projects need very specific skills. This book links theory and practice and provides students and practitioners with the tools to do public history in a wide range of settings. This new edition reflects how much the field of public history has changed in the past few years, with public history now being more established and international. New chapters have therefore been added on the definition, history, and international scope of public history, as well as on specific practices and theories such as historical fictions, digital public history, and shared authority. Split into four sections, this textbook provides approaches, methodologies, and tools for historians and other public history practitioners to play a bigger role in public debates and public productions of historical interpretations: Part I focuses on the past, present, and future of public history. Part II explores public history sources, and offers an overview of the creation, collection, management, and preservation of materials (archives, material culture, oral history, or historical sites). Part III deals with the different ways in which public history practitioners can produce historical narratives through different media (including texts, fictions, audio-visual productions, exhibitions, and performances). Part IV discusses the opportunities and challenges that public history practitioners encounter when working with different collaborators. This book describes Python3 programming resources for implementing decision aiding algorithms in the context of a bipolar-valued outranking approach. These computing resources, made available under the name Digraph3, are useful in the field of Algorithmic Decision Theory and more specifically in outranking-based Multiple-Criteria Decision Aiding (MCDA). The first part of the book presents a set of tutorials introducing the Digraph3 collection of Python3 modules and its main objects such as bipolar-valued digraphs and outranking digraphs. The second part illustrates in eight methodological chapters multiple-criteria evaluation models and decision algorithms. These chapters are mostly problem oriented and show how to edit a new multiple-criteria performance tableau, how to build a best choice recommendation, how to compute the winner of an election and how to rank or rate with incommensurable criteria. The book's third part presents three real decision case studies, while the fourth part addresses more advanced topics, such as computing ordinal correlations between bipolar-valued outranking digraphs, computing kernels in bipolar-valued digraphs, testing for confidence or stability of outranking statements when facing uncertain or solely ordinal criteria significance weights, and tempering plurality tyranny effects in social choice problems. The last part is more specifically focused on working with undirected graphs, tree graphs and forests. The closing chapter explores comparability, split, interval and permutation graphs. The book is primarily intended for graduate students in management sciences, computational statistics and operations research. Chapters presenting algorithms for ranking multicriteria performance records will be of computational interest for designers of web recommender systems. Similarly, the relative and absolute quantiles-rating algorithms, discussed and illustrated in several chapters, will be of practical interest for public or private performance auditors. [less ▲]

La chute de Napoléon, en 1814, marque l’entrée de la France dans un régime d’opinion, résultat d’une mutation de la culture politique qui voit le discours sur la chose publique gagner l’espace extra-parlementaire, donnant lieu à des formes de discours codifiées opposées à celles du débat politique officiel. Dans ce cadre, le pamphlet du premier XIXe siècle apparaît comme le catalyseur et le fruit privilégié de cet abandon progressif des formes longues de l’éloquence politique ; sous la plume de Paul Louis Courier, il se mue en une forme de parole codifiée et stabilisée, avec sa rhétorique, ses images et ses protagonistes (le « je » pamphlétaire en particulier). Or la place centrale accordée à l’auteur pose la question de la légitimité de la pratique polémique, et partant des stratégies mises en place par les pamphlétaires pour justifier leur entreprise de dénonciation ; c’est à ces questions que ce livre est consacré.
