Im Wintersemester 2009/2010 startete das Forschungsprojekt „Sozialreport Trier“. Neben Sekundäranalysen von Daten der amtlichen Statistik und bestehenden Survey Daten wurden auch Primärdaten erhoben. Zum einen eine Onlineerhebung an der Universität Trier, um die Akzeptanz der neuen Hochschulabschlüsse innerhalb der Studierendenschaft zu evaluieren und zum anderen eine Telefonbefragung der Bevölkerung der Stadt. Im Rahmen dieser Befragung ermittlten wir Daten zu den Themenbereichen „Partizipation, Integration und Exklusion“ sowie „Junk and Crime“. Ein besonderes Augenmerk lag neben der Kriminalität und Formen der Belästigungen auch auf der äußeren Erscheinung, der Gebäude, Plätze, Grünanlagen, Denkmäler und Straßen in Trier. Thema sind jedoch nicht die inhaltlichen Ergebnisse dieses „Junk and Crime Surveys“, methodologische Fragestellungen rund um das Mixed Mode Design dieser Studie. [less ▲]

Based on the logic of the Lacanian mirror paradigm, Pierre Legendre claims that every culture needs to create a metaphysical entity of Reference, for the sake of the legiti- macy and validity of its normative system. This entity disguises the abyss at the core of culture and legitimates it by staging itself as its origin. As such, the Reference not only authenticates individual and cultural subjectivity, but also becomes the founda- tion of law. Given that Legendre attributes a fundamental role to aesthetics in the cre- ation of this entity, my essay will identify the role of literature in this respect, arguing that, on the one hand, literary texts help confirming the readers’ attachment to a spe- cific order of Reference, i.e. of normativity and imagery. On the other hand, my essay claims that literature also has the capacity to reflect on the basis of cultural normativity and to unveil the contingency of normative truths. This results from what I call the cultural structures of testimony. Thus literature unleashes emancipatory forces with regard to a culture’s normative system. The essay tests this hypothesis by analysing E.T.A. Hoffmann’s The Sandman, a narrative that because of its play with the catego- ries of fiction and reality is particularly salient. [less ▲]

Despite the exclusion of arbitration from the European law of jurisdiction and judgments (Brussels I bis Regulation, Lugano Convention), the European Court of Justice has ruled in the Van Uden case that the jurisdiction of the courts of the Member or contracting States to grant at least certain interim measures in aid of arbitration is governed by these European instruments. This Article explores the consequences of the application of European law on the power of courts to grant such measures and in particular defines the scope of European law in this respect and the limitations that it establishes on the jurisdiction of the courts of the relevant European states. This article examines a 14th-c. translation into Old Occitan prose of a late-antique life of Alexander the Great: Justin?s Epitome of the 'Historia Philippicae' of Pompeius Trogus. The article argues that it is the work of translators whose knowledge of pagan Latin materials was incomplete and whose use of their native tongue rested on non-literary bases. This text has not been edited before, and examining its uneven treatment of its source provides important new insights into the work of translators in the later Middle Ages. In conclusion, the article suggests some new approaches to the understanding of translation as a process of reconstruction and adaptation. [less ▲]

With stunning green landscapes, exemplary public transport, and picturesque walkable cities, Switzerland often occupies the public imaginary of a place that has tackled sustainable development. This research, however, looks under the hood and finds that this development path supports not only modes of capital accumulation, but also certain less sustainable patterns of development and governance. This paper examines this apparent paradox by looking at the role of sustainable development as a master-signifier in Swiss urban development processes. Empirical observations were made in the Glatt Valley of Switzerland, where governing officials of small municipalities are confronted with coordinating urban development under growth pressure within cantonal and federal policy frameworks that claim sustainable development. It can be seen that sustainable development is an empty master-signifier that policy makers engage to justify the quilting of a certain hegemonic discourses of power that reflect in further uneven urban development. By reproducing business as usual market-led urban growth, fragmentation is maintained as are social spatial disparities are entrenched. [less ▲]

The transition from analogue to digital archives and the recent explosion of online content offers researchers novel ways of engaging with data. The crucial question for ensuring a balance between the supply and demand-side of data is whether this trend connects to existing scholarly practices and to the average search skills of researchers. To gain insight into this process we conducted a survey among nearly three hundred (N= 288) humanities scholars in the Netherlands and Belgium with the aim of finding answers to the following questions: 1) To what extent are digital databases and archives used? 2) What are the preferences in search functionalities 3) Are there differences in search strategies between novices and experts of information retrieval? Our results show that while scholars actively engage in research online they mainly search for text and images. General search systems such as Google and JSTOR are predominant, while large-scale collections such as Europeana are rarely consulted. Searching with keywords is the dominant search strategy and advanced search options are rarely used. When comparing novice and more experienced searchers, the first tend to have a more narrow selection of search engines, and mostly use keywords. Our overall findings indicate that Google is the key player among available search engines. This dominant use illustrates the paradoxical attitude of scholars toward Google: while provenance and context are deemed key academic requirements, the workings of the Google algorithm remain unclear. We conclude that Google introduces a black box into digital scholarly practices, indicating scholars will become increasingly dependent on such black boxed algorithms. This calls for a reconsideration of the academic principles of provenance and context. [less ▲]
