[more ▼] Judicial independence did not only become more visible in the recent case law of the Court of justice but has also been analysed as a systemic parameter of the Union. This article discusses a sample of three cases, Associação Sindical dos Juízes Portugueses, Achmea, and L.M., to assess the notion of judicial independence as applying regarding the national judges in the judicial system of the Union. Judicial independence, as a notion of EU law, is primarily a constitutional requirement presumably deferent to Member States’ standards and pursuing the proper functioning of the Union’s judicial system, namely its effectiveness. However, the recent case law testifies the emergence of a common EU standard of judicial independence, which does not only apply as a minimum standard throughout the Union but also affects the national legal orders. Ultimately, the analyses of the paper point out a curious harmony regarding judicial independence between the principles of effectiveness of Union law and of effective judicial protection under that law without clarifying their articulation. The present article aims to examine the possibilities of judicial protection enjoyed by the suspects who are investigated by OLAF. The article will attempt to show that the Court’s case-law concerning the admissibility conditions for actions for annulment deprives in practice the applicant from effectively challenging any illegal activities of OLAF. The first part will deal with the remote possibility of an action for annulment, while the second part will demonstrate that the legal remedy of the action for damages can only tackle a minor part of OLAF’s activities, rendering its actions practically free from judicial control. The expectation of “a complete system of legal remedies and procedures” in the case of OLAF is proven to be particularly ambitious. The purpose of this article is to shed some light in the lacuna of the judicial control of OLAF’s actions and to identify appropriate ways to ensure that the rights of the persons under investigation are being fully respected. [more ▼] French judges regularly refuse to enforce foreign judgements rendered by default against a defendant who has not appeared. This finding is also true for other Member States, as many European regulations govern cross-border enforcement of decisions rendered in civil and commercial matters between Member States. The present study examines this problem in order to understand the obstacles to the circulation of default decisions and payment orders in Europe. When referring to the recognition of default judgments, it would be more accurate to refer to the recognition of decisions made as a result of default proceedings. It is indeed this (default) procedure, more than the judgment itself, which is examined by the exequatur judge to determine whether the foreign decision should be enforced. This study is therefore firstly devoted to default procedures and payment order procedures in French, English, Belgian and Luxembourgish laws. These procedures are analysed and compared in order to highlight their differences, be they conceptual or simply technical in nature. Once these discrepancies have been identified, this study turns to private international law in order to understand which elements of the default procedures are likely to hinder their circulation. The combination of these two perspectives makes it possible to envisage a gradual approximation of national default procedures in order to facilitate their potential circulation in the European area of freedom, security and justice. Denn die Gruppe der Jugendlichen repräsentiert mit ihren Wünschen, eigenen Sichtweisen und Erwartungen eine zentrale Entwicklungsperspektive für die Gemeinde Strassen. Unter anderem aus diesem Grund sind die Ergebnisse dieser Studie eine wichtige Informations- und Diskussionsgrundlage für die zukünftige Planung und Umsetzung der kommunalen Jugendpolitik und ein wichtiges Fundament für „Evidence-based-policy-making“, also eine wissensbasierte Jugendpolitik in Strassen. Diesem Anliegen entsprechend wurde diese Studie als Situations- und Bedarfsanalyse konzipiert. Wichtige thematische Aspekte sind insbesondere die Lebenswelten, das Freizeitverhalten und die Freizeitinteressen der Jugendlichen in Straßen aber auch die sozialen Herkunftsmilieus die einen starken Einfluss auf die Startbedingungen, Lebensentwürfe und Zukunftsperspektiven der Jugendlichen haben. Nicht zuletzt interessiert auch die Frage, wie die Jugendlichen unterschiedlicher Herkunft in der Gemeinde integriert sind, wie zufrieden sie mit den Angeboten und der Infrastruktur sind, welche Möglichkeiten der Partizipation für sie wichtig sind und inwiefern die Maßnahmen und Angebote der kommunalen Politik die Jugendlichen erreichen. In diesem Zusammenhang ist auch ein genauerer Blick auf die Situation der Jugendlichen mit einer ausländischen Nationalität von Interesse, zum Beispiel die Frage, wo Defizite aber auch Chancen einer stärkeren Integration oder Beteiligung dieser großen Zahl an Jugendlichen am Gemeindeleben bestehen. Bei vielen Themenbereichen sind Vergleiche mit anderen luxemburgischen oder mit internationalen Jugendstudien möglich.
