[more ▼] Efficient translation of research discoveries into clinical application is essential to improve human health and maintain Europe’s competitiveness in biomedical research and in health industry. A major bottleneck is the lack and the frag- mented nature of research infrastructure and know-how, leading to unacceptable delays or preventing of the development of new innovative medicines. The aim of EATRIS, European Advanced Translational Research InfraStructure in Medicine, is to fill this gap by developing a pan-European research infrastructure. [more ▼] Do financial crises promote or hamper transatlantic regulatory cooperation in banking? This article argues that financial crises have an impact upon the alignment of regulatory preferences of the United States (US) and the European Union (EU), causing an ‘ebb and flow’ in transatlantic cooperation. When EU-US preferences are broadly aligned in periods of financial stability, transatlantic regulatory cooperation is intense. It is relatively easy for the EU and US to agree on market-friendly regulation promoted by banks. When preferences are different, especially in the context and aftermath of the exogenous shock of financial crises, transatlantic cooperation is more problematic because crises re-assert the importance of nationally embedded patterns of market organisation. [more ▼] After over a decade of crisis, the ECB’s functions have expanded considerably, which in turn altered its relationship with other institutions. In particular, when the ECB assumed the role of Banking Supervisor under the Single Supervisory Mechanisms, it was generally accepted that this role would require more accountability than its traditional role in monetary policy. Yet, accountability requires transparency. However, there is a dearth of studies on the transparency of European banking supervision, and the few that exist are usually single case studies. This leaves us without a point of comparison that would help us understand what constitutes a “transparent banking supervisor”. Therefore, the aim of this article is to situate the transparency of the ECB within the wider literature on the transparency of banking supervisors. This allows us to pinpoint more precisely its strengths and shortcomings and the potential for reforms. [more ▼] Council Regulation No 1024/2013 (‘SSM Regulation’ or ‘SSMR’) confers exclusive competence on the ECB to carry out specific supervisory tasks with regard to credit institutions established in the Euro Area Member States. When the ECB carries out its supervisory tasks, it is “considered, as appropriate, the competent authority or the designated authority in the participating Member States as established by the relevant Union law”. Any reference made in the CRD IV to a National competent authority (NCA) shall thus be read as a reference to the ECB whenever the ECB is competent. However, this does not turn the ECB into a super NCA. Although the SSMR has granted the ECB most of the powers necessary to carry out its new tasks, the ECB lacks certain specific powers that national laws have given to national supervisors. Filling this gap and ensuring a high level of consistency in the exercise of prudential supervision require the definition of complex administrative composite procedures where the identification of responsibility and accountability of the ECB and the NCAs is particularly blurred. Ten years after the creation of the SSM, it will be time to consider a number of developments in the legal framework, as this contribution will discuss in conclusion.
