In this case, English courts denied recognition to an ICC arbitral award made in Paris for lack of jurisdiction of the arbitral tribunal over the Government of Pakistan. Although it also briefly discusses the other issues addressed in the judgment, the note focuses on the decision of the English court to assess whether the arbitral tribunal had jurisdiction pursuant to French law despite the fact that the tribunal had reached its decision by application of transnational principles, and that French law also provides that arbitration agreements are not governed by national law, let alone the law of the seat of the arbitration, but rather by transnational principles. The note concludes that the pro-arbitration policy of the New York Convention should have led the English court to take into account French conflict of laws rules. [more ▼] In most cases, awards are either paid in a way which satisfies the award creditor, or not paid at all. When awards are paid to the satisfaction of all involved parties, no issue arises. When the award debtor does not want to pay, the award creditor may seek enforcement of the award. There are, however, instances where performance may raise issues irrespective of enforcement. First, the award debtor may wish to perform the award in a way which does not satisfy the award creditor. Second, the debtor may argue that an event has occurred that entitles him not to pay the award. In these cases, it is necessary to determine which rules govern, but there are no enforcement proceedings involved, or at least not necessarily. This paper explores the choice of law issues raised by the performance of arbitral awards. It identifies the different approaches to the problem depending on the various conceptions of international arbitration and how the issues under scrutiny are traditionally characterized for choice of law purposes. It then surveys the different solutions adopted by courts. [more ▼] Arbitration is a creature of contract. It is a mode of dispute resolution which is only available to parties who have agreed to resort to it. Yet, it is widely perceived as the most suitable and the dominant method for the settlement of international commercial disputes. Why is it, then, that parties must opt in for a solution which appears as the most natural one in the community? The Article explores whether arbitration could become a default solution and thus lose its contractual foundation. The core of the Article discusses the numerous objections that such a proposition raises. Most importantly, I argue that the legitimacy of arbitrators would not be significantly lower than the legitimacy of courts, and that recent developments in specialized fields of international arbitration have shown that arbitrators can serve the public functions of courts. At the end of the Article, a model of non-consensual arbitration is proposed.
