Cette note commente les décisions contradictoires rendues par les juges du contrôle anglais et français dans l’affaire Dallah. Dans cette affaire, le juge anglais a refusé d’octroyer l’exequatur à une sentence arbitrale rendue à Paris pour défaut de compétence du tribunal arbitral, avant que le juge français rejette un recours en annulation exercé sur le même fondement. Ce commentaire compare les motivations des deux juges, et conclut que la Convention de New York aurait pu conduire le juge anglais à se prononcer dans un sens différent. [less ▲]

Depuis une dizaine d’années, les juges anglais et espagnols ont accepté d’octroyer des dommages et intérêts aux parties ayant été poursuivies devant un juge non élu en violation d’un accord sur la compétence. Après avoir présenté cette jurisprudence, l’article s’interroge sur l’admissibilité de cette sanction, tant en droit international privé commun que dans le cadre du droit judiciaire européen. In this paper we would like to thoroughly cover the problem of computing all kernels, i.e. minimal outranking and/or outranked independent choices in a bipolar- valued outranking digraph. First we introduce in detail the concept of bipolar-valued characterisation of outranking digraphs, choices and kernels. In a second section we present and discuss several algorithms for enumerating the kernels in a crisp digraph. In this communication we propose two logically sound fuzzification and defuzzifi- cation techniques for implementing a credibility calculus on a set of propositional expressions. Both rely on a credibility evaluation domain using the rational in- terval [−1, 1] where the sign carries a split truth/falseness denotation. The first technique implements the classic min and max operators where as the second technique implements Bochvar-like operators. Main interest in the communica- tion is given to the concept of natural fuzzification of a propositional calculus. A formal definition is proposed and the demonstration that both fuzzification techniques indeed verify this definition is provided. [less ▲]

In this paper we propose to apply the concept of L-valued kernels to the problem of constructing a global ranking from a pairwise L-valued outranking relation defined on a set of decision alternatives as encountered in the fuzzy preference modelling context. Our approach is based on a repetitive selection of best and worst candidates from sharpest L-valued or most credible initial and terminal kernels. A practical illustration will concern the global ranking of movies from individual evaluations of a given set of movie critics. [less ▲]
