Annotated Legal Documents on Islam in Luxembourg consist of an annotated book of currently valid legal documents affecting the status of Islam and Muslims in Luxembourg. By legal documents are meant the texts of legislation, including relevant secondary legislation, as well as significant court decisions. Each legal text will be preceded by an introduction describing the historical, political and legal circumstances of its adoption, plus a short paragraph summarising its content. The legal texts will be published in the original language while the annotations and supporting material will be in English. The focus of the book is on the religious dimensions of being Muslim in Luxembourg, i.e. on individuals' access to practise their religious obligations and on the ability to organise and manifest their religious life. It's a part of a project will cover the 28 member states of the European Union (including Croatia), Norway and Switzerland plus the European Union and the European Court of Justice. [less ▲]

Depuis les référendums sur le feu Traité constitutionnel européen en 2005 et suite au déclenchement de la crise de la dette souveraine d’Etats membres de la zone euro en 2009, la confiance accordée par les citoyens à l’Union européenne et aux gouvernements qui la composent s’affaiblit. Le scrutin pour désigner le nouveau Parlement européen en mai 2014 a confirmé ce « réalignement électoral » au profit de forces politiques qui sont classées et/ou qui se considèrent parfois elles-mêmes comme relevant du « populisme ». Ce rapport de force inédit nous oblige à traiter « à nouveaux frais » de l’identité des populismes et de leurs rapports à la démocratie d’autant plus qu’ils aspirent désormais, s’ils ne l’ont pas déjà fait, à exercer des fonctions gouvernementales. Bien plus, il n’existe aucune théorie politique qui ne se réfère directement ou indirectement à l’égalité ou à l’inégalité à un point tel qu’on puisse dire que, dans la plupart des cas, du moins depuis les Révolutions américaine et française, la justice d’un ordre social et politique se traduit par l’égalité ou l’inégalité entre ses membres. D’où la controverse qui entoure son usage dans les contextes sociaux et politiques. C’est à juste titre qu’on a pu dire que la justice représente un “essentially contested concepts”.1 Néanmoins, même en politique, ce ne sont pas toutes les occurrences ou emploi du terme égalité ou inégalité qui devraient donner lieu à des contestations. Leurs contributions en anglais et en français visent à comprendre les différentes transformations de la démocratie représentative dans un système concurrentiel des formes démocratiques (participative, délibérative, etc.) et de nouvelles hiérarchisations législatives (l’européanisation, le fédéralisme et le parlementarisme rationalisé). Il s’agit en premier lieu d’analyser les députés et la fabrication contemporaine de la loi, c’est -dire comment ils travaillent dans les commissions, usent de leurs pouvoirs d’interpellation et quels sont leurs rapports aux groupes d’intérêts. The 50th anniversary of the death in 1967 of the famous music teacher, ethnomusicologist and composer Zoltán Kodály reminded us that another renowned music pedagogue, Leo Kestenberg (1882-1962), was born in the same year as Kodály. As such, the joint Kodály Kestenberg Conference provided a welcome opportunity not only to address aspects of music pedagogical and biographical research which had hitherto received a limited amount of attention, but also to highlight a number of key moments in history, and the resulting impact these had had on music pedagogy. The significant level of international interest which music educators showed in the Kodály Kestenberg Conference fulfilled the organisers' desire to create a forum for the free exchange ideas. It also enabled participants to review our commonalities and differences and to look beyond our individual national developments and evaluate the methods and concepts of two significant personalities in the history of musical education in the first half of the 20th century. The sheer diversity of historical and current topics in music education research both inside and outside of Europe, not only reflects the fact that in the 21st century, music education research has established and profiled itself in a wide range of sub-disciplines in addition to revealing new fields of inter-disciplinary research. The effectiveness of reforms initiated and implemented by Kodály and Kestenberg extend to the present day and continue to influence discussions around the future perspectives of music education. This is illustrated by the example of formal and informal learning in the field of elementary music pedagogy. The "Century of the Child" proclaimed in 1900 by the Swedish reform pedagogue Ellen Key (1849–1926) has left its mark on music education through reformers such as Kodály and Kestenberg into the 21st century. This conference book contains articles which are subdivided in five sub-categories: (1) The function of Music Education, (2) The Historical Era of Kodály and Kestenberg, (3) Learning and Instruction, (4) Assessment Technologies in Music Education and (5) Effects of Music Training. The contributors come from six different countries namely, Austria, England, Germany, Hungary, Israel and Luxembourg. The editors would like to record their thanks to both: (1) the Pedagogical Faculty of the John von Neumann University, Kecskemét and the dean Dr. Fülöp Tamás and the vice-dean Dr. Sági Norberta for hosting the conference, (2) the International Leo Kestenberg Society. In the aftermath of the financial crisis, the individual liability of senior managers has been rediscovered as an important element in effectively countering economic and financial crime. Mainstream enforcement practices against white-collar crime in recent years, focusing mostly on the legal entity or the low- and mid-level employees, have been largely unsuccessful. The punishment of large corporations for economic offences has indeed been confronted with the “too big to jail” dilemma, and with concerns for the negative spillovers that their collapse may entail for employees, shareholders and consumers. The individual “rogue employee”, on the other hand, may be fungible and easily sacrificed as a scapegoat. The recent debate has therefore brought back to centre-stage the individual liability of senior managers, which is essential to close any “responsibility gap”. But are the ordinary rules of criminal law fit and adequate to hold senior managers accountable? This volume, presenting the findings of a study led by the University of Luxembourg and co-financed by the European Anti-Fraud Office (OLAF), aims to contribute to this debate with a special focus on the liability of senior managers for the commission of offences against the financial interests of the EU. It compares the criminal liability regimes for senior managers in five Member States (Finland, France, Germany, The Netherlands and Poland) and delivers a set of policy recommendations for establishing the liability of senior managers in compliance with the general principles of criminal law and respect for fundamental rights. Gleichzeitig verändern Massenmedien wie Zeitungen, Radio oder das Kino die Sicht der Menschen auf die Welt. Neue Maschinen und Werkstoffe, Traktoren und Lkw erhöhen die Produktivität und Mobilität der Welt. Telefon und Wanderbewegungen sind äußere Zeichen einer Moderne, die in der kleinen Grenzregion Eupen-Malmedy gleichzeitig so nah und so fern sein kann. Der vorliegende Band versteht sich als Beitrag zu den internationalen Modernismus-Studien. Zum ersten Mal werden Spannungen, Interaktionen und Friktionen in der kulturellen Welt sowie die Koexistenz von Tradition und Innovation im Luxemburger Kontext in einem interdisziplinären Sammelband mit einander in Verbindung gebracht. Die Beiträge thematisieren Gleichzeitigkeiten und Interaktionen zwischen den verschiedenen Kunstfeldern Architektur, Kunst und Literatur auf. Mit Beiträgen in vier Sprachen, Luxemburgisch, Deutsch, Französisch und Englisch, spiegelt der Band die mehrsprachige Realität des Luxemburger Forschungskontextes wieder und richtet sich sowohl an ein Luxemburger als auch an ein internationales Publikum. Diskussionen zur Natur der Moderne in spezifischen Kontexten bewegen sich häufig innerhalb der Dualität ›modern vs. traditionell‹, wobei die Tradition oft mit Rückständigkeit assoziiert wird. In recent years, half of the newly constructed building floor areas in the world are built in China, thus it is important and interesting to know the Chinese design codes for buildings and compare them with Eurocodes, which are one of the most advanced design codes in the world. Funded by “Erasmus+ Strategic Partnerships” the project “AVEC BNT” was started in 2016 to compare the design codes mainly related to concrete structures and composite structures. This script is the main intellectual outputs from this project. It comprises codes background analysis, direct codes terms comparison and design examples. The script covers most of the design topics related to design of concrete structures and composite structure for building design as well as the design basics such as safety concept. It is a common achievements of students, researchers and professors from different universities and instructions of different countries. The main work is done at University of Luxembourg especially for the design basics part and the design of composite structure of steel and concrete. For design of concrete structure part, University of Applied Science Trier (Germany) and Thei (Hong Kong, China) has offered great helps and contributed many parts. To conform with the goals of Erasmus+ to promote the cooperation and mobility with the EU’ partner countries and to promote the sustainable development of its partners in the field of higher education and contribute to achieving the objectives of the EU Youth Strategy, the script involves many student’s work. The students could participate in the project through either joining special courses offered by the project partners, as well as, doing a student project, bachelor or master thesis related to this project. Further more the students participated within the transnational teaching activity weeks. With the guidance, the students were able to learn and compare difference design methods by EuroCodes and Chinese design codes and to cooperate with their colleges from different countries. To achieve good quality of the final script, which can be used as additional information and learn material for other students and engineers to learn about Eurocodes and Chinese codes for structural design. Also the work was edited into a uniform formatting to make it constant in style and easy to read. Although, besides the contribution from students, many other topics were added to make the documents complete, it was not possible to cover every topic in the codes due to the limited time and resources. Thus, topics such as fire design, seismic design, bridge design, pre-stressed structures and others are not within the scope of the work. The scripts are divided into 7 sub chapters and many small topics. Each topic has two main documents for Eurocodes and Chinese codes. The main documents have same list of contents, which allows readers to compare the design aspects from the two codes systems easily side by side. Besides that, each topic is also provided with a general summary of comparison, which points out the most important difference and general overview of the design. In the documents not only the content of the codes but also the background information is discussed, which will help students and engineers to understand not only the difference of design but also the reasons behind it. The European Union has adopted several Directives harmonising the rights of the suspects and accused persons in criminal proceedings. The effectiveness of defence rights granted by EU legal instruments does not simply rely on their correct implementation in national law, but also depends on the existence of enforcement and control mechanisms granting judicial protection to individuals. Although the Directives impose remedial obligations on the Member States, the different structure and scope of judicial control under national law is likely to undermine the justiciability of procedural safeguards granted by EU law. Divergences among national criminal justice systems raise further challenges in the field of cross-border cooperation. In light of the recent case law of the European Courts, the present book explores the scope and meaning of the right to effective judicial protection in criminal proceedings in relation to the first three Directives of the Stockholm roadmap. It offers a comparative analysis of the national implementations of these so-called ABC Directives in six Member States, focusing on legal remedies that ensure the effectiveness of the rights granted by the EU Directives. This volume presents the results of a study carried out by a group of European criminal law experts from 2015 to 2017 thanks to the financial support of the EU Commission. [less ▲]

In an attempt to strengthen the legitimacy of EU policy-making, the 2009 Lisbon Treaty strengthened the principle of parliamentary control in EU affairs. This pertains to parliaments at all levels ranging from the regional to the supranational level. This book analyses the potential of regional parliaments – the parliaments closest to the citizens – to engage in EU affairs and to fill the perceived legitimacy gap. Eight member states have a total of 73 regional parliaments with legislative powers, and there are further trends towards decentralization in Europe. On its quest to understand the role that regional parliaments can plan in the EU multilevel parliamentary system, the book addresses key questions: What are the formal powers and functions of regional parliaments in EU policy-making? Die Konjunktur des Politischen in neueren Kinofilmen und Fernsehserien ist mit tradierten Oppositionen – wie der von Inhalt und Form – nicht mehr zu beschreiben. Vielmehr lässt sich konstatieren, dass Theorie und Praxis des Politischen längst mit filmischen Fiktionen verflochten sind: Diese vermitteln zwischen universalen und partikularen Perspektiven, entwerfen Figurentypen und Verhaltensmuster und intervenieren in aktuelle Diskurse. Ein neuer »medialer Realismus«, der diese Unhintergehbarkeit der Medien selbst sichtbar macht, bildet den thematischen Horizont der Beiträge dieses Sammelbands. A multitude of devices and technological tools now exist to make, share, and store memories and moments with family, friends, and even strangers. Memory practices such as home movies, which originated as the privilege of a few, well-to-do families, have now emerged as ubiquitous and immediate cultures of sharing. Departing from the history of home movies, this volume offers a sophisticated understanding of technologically mediated, mostly ritualized memory practices, from early beginnings in the fin-de-siècle to today. Departing from a longue durée perspective on home movie practices, Materializing Memories moves beyond a strict historical study to grapple with highly theorized fields, such as media studies, memory studies, and science and technology studies (STS). The contributors to this volume reflect on these different intellectual backgrounds and perspectives, but all chapters share a common framework by addressing practices of use, user configurations, and relevant media landscapes. Grasping the cultural dynamics of such multi-faceted practices requires a multidimensional conceptual approach, here achieved by centering around three concepts as central analytical lenses: dispositifs, generations, and amateurs. Care for elderly persons has many facets and is influenced by many factors of the care-dependent person, the care giver(s) and the micro-, and macro-social context. A co-operation of multiple disciplines is required to better understand phenomena of elder care and to act adequately in this field. This is even more urgent given the increasing population aging and the impending gaps between demand and supply of care. The present book provides a first substantive integration of knowledge from geropsychology, other gerosciences, and cultural psychologies to reach these goals —through a multi-disciplinary and international cast of authors. Macro-social context—including demographic, historical, political, normative, and other cultural factors—turned out to open and limit the available options for individual care giving and receipt and shapes how these issues are experienced by the participants in elder care. Elder care is shown to be far more complex than previously thought, because its consequences extend beyond single care givers to multigenerational caring families. Thinking, feeling and acting in relation to care dependency, caregiving and care receipt emerged as being influenced by multiple individual and social level factors. Future issues of elder care are seen as being shaped to a large extent by macro level factors such as population aging, social trends in job and family life, and development of assistive technologies. All this has far reaching implications for ensuring quality of care and the life quality on part of care recipients and care providers and for the coherence of social communities. [less ▲]

Friedhelm Brusniak will have duly celebrated his sixty-fifth birthday with birthday cake, sparkling wine and other culinary delicacies in the family. The present academic birthday cake is addressed to the friend and colleague Friedhelm Brusniak in recognition of his life achievement. The authorship is composed of companions with whom Friedhelm Brusniak, on the one hand, was, closely connected during his long career as a scholar, and, on the other hand, with fellow researchers, he came later into contact as a networker in the international context. For the editor, it was important that the academic freedom of every one should be respected and that no restrictions should be imposed on the authors. The 21 articles, in four languages – German, English, French, Italian – are published in alphabetical order of the authors. (The only exception are the texts by Andreas Eschen and Anna-Christine Rhode-Jüchtern. They are related and printed successively.) The authors come from Germany, France, Great Britain, Italy, Luxembourg, Austria, Poland, Slovenia, Hungary and the United States of America. The portrait at the beginning of the book was drawn by Barbara Plattner. The articles are preceded by four greeting messages, including a sounding one composed by longtime friend Heinz Werner Zimmermann. Although ordered without a thematic context, the contributions reflect the considerable spectrum of the long-standing scientific work of Friedhelm Brusniak. In addition to his ambitious work as a university professor and scholar, he did never refrain from accepting additional responsibilities, e.g. from 1994 to 2002 as President of the German Mozart-Society and from 2009 to 2013 as the first chairman of the Hermann Zilcher Society. The texts in connection with Leo Kestenberg occupy a large part of the book. This will be noted with satisfaction by Friedhelm Brusniak, president (since 2012) of the International Leo-Kestenberg-Society. Furthermore, the reader will find texts on choral, wind and amateur music research ("community music") as well as on questions of music education in a historical context and an empirical perspective. Also, the contributions cover a timeframe of more than 400 years. They deal s.l. with cultural heritage in a multi-faceted Europe and beyond. Finally, the essays with a philosophical-religious background and in connection with Freemasonry should be emphasized do not stand alone but should be considered as an integrative part. The editor is particularly satisfied and grateful from coming personally in contact with Karl-Heinrich Ehrenforth, the esteemed colleague and friend of Friedhelm Brusniak, and that Prof. Ehrenforth probably provided his last publication to this Festschrift. After his death, his daughter, Christiane Ehrenforth, granted permission to publish. Friedhelm Brusniak’s affinity for interdisciplinarity was met more unconsciously than consciously. He uses the term "interface research"! This has been the case for biography research since his employment with Conrad Rein as well as for musicological research from his home region Waldeck. This is especially true for choral music research, which became his central field of scholarship at the beginning of the nineties. Friedhelm Brusniak comes from a family wind musicians. In the research efforts of the International Society for the Research and Promotion of Wind Music (IGEB), he recognised the congeniality to choral music research, s.l. "community music". For many years now, his contributions to IGEB conferences have received much attention. Conversely, Friedhelm Brusniak received, since the beginning of the eighties, the decisive impulses from the IGEB under Wolfgang Suppan, which he was able to transfer to choral music research and to the Singer Museum in Feuchtwangen, where he serves as a scientific head. As a trained music educator and chair of the Department of Music Education at the University of Würzburg, Friedhelm Brusniak maintained European and international partnerships with music pedagogues, initially in the Arbeitsgemeinschaft Süd (AG Süd) and then in the Forum of European Music Pedagogy (FEMP). His connection with Luxembourg, at the intersection of French and German music pedagogic traditions, was a matter of concern to Friedhelm Brusniak. He was particularly inspired to detect and expand European networks. Please refer to Martin Straus, who provides a more detailed glimpse in the following article. The number of non-German authors is an impressive proof of Friedhelm Brusniak’s constant and interesting view across the borders of his country and his successfully established and maintained contacts.
